Section 1 of the Early Childhood Services Act,

chapter E-0.5 of the Acts of New Brunswick, 2010, is amended 1 L’article 1 de la

a) by repealing the definition “operator” and sub- stituting the following:

section 36.2 of the Family Services Act; or

section 18 the following: 12 La Loi est modifiée par l’adjonction de ce qui suit après l’article 18 : Inclusion Inclusion 18.1(1) An operator of a licensed facility shall provide services in an inclusive environment that respects the di- versity of children and families related to race, colour, creed or religion, national origin, ancestry, place of ori- gin, age, disability, marital status, family status, sexual orientation, sex, gender identity or expression, social condition and political belief or activity. 18.1(1) L’exploitant d’un établissement agréé veille à ce que ses services soient offerts dans un milieu inclusif, c’est-à-dire qui respecte la diversité des enfants et des fa- milles quant à leur race, leur couleur, leur croyance ou religion, leur origine nationale, leur ascendance, leur lieu d’origine, leur âge, leur incapacité, leur état matrimonial, leur situation familiale, leur orientation sexuelle, leur sexe, leur identité ou expression de genre, leur condition sociale ou leurs convictions ou activités politiques. 18.1(2) An operator of a licensed facility shall develop and implement an inclusion policy. 18.1(2) L’exploitant d’un établissement agréé élabore et met en œuvre une politique d’inclusion. 18.1(3) An inclusion policy shall include the follow- ing: 18.1(3) La politique d’inclusion indique notamment : (

a) how the operator will create an environment at the facility that supports, reflects and promotes equi- table and inclusive practices to ensure that services are responsive to the needs, values and cultural beliefs of the families using the services;

a) there is an imminent danger to the health, safety or well-being of a child who is receiving services at the licensed facility, or

b) the operator has failed to ensure that

i) no child receiving services at the licensed fa- cility is subjected to any form of physical punish- ment or verbal or emotional abuse, or (

(ii) soit ne soit privé de ses nécessités physiques. 28.1(2) In a protection order, the Minister may 28.1(2) L’arrêté de protection peut : (

a) order the licensee to stop operating the licensed facility until the Minister is satisfied that the order has been complied with,

b) order that the licensee eliminate the danger and take any other measures set out in the order, and

c) suspend the licensee’s licence.

Court order Ordonnance de la cour 28.2(1) If the Minister has reasonable grounds to be- lieve that an individual who provides services in a li- censed facility poses an imminent danger to the health, safety or well-being of a child who receives services at that facility or that the individual has subjected a child receiving services at that facility to any form of physical punishment or verbal or emotional abuse or that the indi- vidual has denied a child receiving services at that fa- cility physical necessities, the Minister may apply to the court for an order prohibiting the individual from provid- ing services. 28.2(1) S’il a des motifs raisonnables de croire qu’une personne en particulier fournissant des services dans un établissement agréé représente un danger imminent pour la santé, la sécurité ou le bien-être d’un enfant qui y est bénéficiaire de services ou qu’elle fait subir quelque pu- nition physique ou violence verbale ou psychologique à un tel enfant ou le prive de ses nécessités physiques, le ministre peut, par voie de requête, demander à la cour de rendre une ordonnance lui interdisant de fournir les ser- vices. 28.2(2) The Rules of Court apply to an application un- der subsection (1). 28.2(2) Les Règles de procédure s’appliquent à la re- quête visée au paragraphe (1). 28.2(3) On an application under subsection (1), the court may issue an interim order without a hearing if it is satisfied that it is in the public interest to do so. 28.2(3) Sur requête présentée en vertu du paragra- phe (1), la cour peut, sans tenir d’audience, rendre une ordonnance provisoire si elle est convaincue que l’intérêt public le commande. 28.2(4) Any person may apply to the court for an order varying or revoking an order issued under subsection (1). 28.2(4) Toute personne peut, par voie de requête, de- mander à la cour de rendre une ordonnance modifiant ou révoquant celle rendue en vertu du paragraphe (1). 16 Subsection 29(5) of the Act is amended by striking out the portion preceding paragraph (

d) the Minister is of the opinion that there is an im- minent danger to the health, safety or well-being of a child who is receiving services at the licensed facility,

e) in the case of a suspended licence for which a probationary licence has been issued, the Minister is of the opinion that
