B.C. Reg. 43/2009 , deposited March 2, 2009, pursuant to the LIQUOR CONTROL AND LICENSING ACT [Section 84]. Order in Council 90/2009, approved and ordered February 27, 2009.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective on the date

section 3 (1) of the Tsawwassen First Nation Final Agreement Act, S.B.C. 2007, c. 39 comes into force, the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended

(

a) in

section 1 (1) in paragraph (

c) of the definition of "occupant load" by striking out " local government or first nation " and substituting " local government, first nation or treaty first nation ", and

(

b) by repealing

section 46 (3) and substituting the following:

(3) Despite subsections (1) and (2), a local government May by bylaw, a first nation May by any lawful means provided under the Indian Act (Canada) or authorized by a treaty with the governments of Canada and British Columbia, and a treaty first nation May by law if authorized under its final agreement, restrict or prohibit the type of entertainment or games allowed in a licensed establishment.
