B.C. Reg. 105/2021 , deposited April 7, 2021, under the LIQUOR CONTROL AND LICENSING ACT [sections 80 and 82] and the LIQUOR DISTRIBUTION ACT [section 37]. Order in Council 225/2021, approved and ordered April 7, 2021.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended as set out in the attached Appendix 1, effective on the dates as set out in that Appendix, and

(

b) the Liquor Distribution Regulation, B.C. Reg. 611/76, is amended as set out in the attached Appendix 2.

Appendix 1

1 Effective on the date this regulation is deposited under the Regulations Act,

section 9.1 of the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended

(

a) in subsection (1) by striking out " and " at the end of paragraph (

b) and by adding the following paragraph:

(b.1) a licensee to enclose draught beer in a container and

(

i) deliver and sell the beer in the container in accordance with paragraph (a), or

(ii) sell and transfer possession of the beer in the container in accordance with paragraph (b), and ,

(

b) in subsection (1) (

c) by striking out " has taken possession " and substituting " has, in accordance with paragraph (b), taken possession ", and

(

c) by adding the following subsection:

(3) Subsection (1) (b.1) and this subsection are repealed 60 days after the date on which this subsection comes into force.

2 Effective on the date this regulation is deposited under the Regulations Act,

section 16.1 is amended

(

a) in subsection (1) by striking out " and " at the end of paragraph (

b) and by adding the following paragraph:

(b.1) a licensee to enclose draught beer in a container and

(

i) deliver and sell the beer in the container in accordance with paragraph (

a) and subsection (3), or

(ii) sell and transfer possession of the beer in the container in accordance with paragraph (

b) and subsection (3), and ,

(

b) in subsection (1) (

c) by striking out " has taken possession " and substituting " has, in accordance with paragraph (b), taken possession ", and

(

c) by adding the following subsection:

(4) Subsection (1) (b.1) and this subsection are repealed 60 days after the date on which this subsection comes into force.

3 Effective 60 days after the date on which sections 1 and 2 of this Appendix come into force, the Liquor Control and Licensing Regulation is amended

(

a) in

section 9.1 (1) by adding " and " at the end of paragraph (b), and

(

b) in

section 16.1 (1) by adding " and " at the end of paragraph (b).

Appendix 2

1 The Liquor Distribution Regulation, B.C. Reg. 611/76, is amended by adding the following section:

Manufacture

4.1

(1) The liquor prescribed for the purposes of the definition of "manufacture" in

section 1 (1) of the Liquor Distribution Act is draught beer that a licensee encloses in a container under sections 9.1 (1) (b.1) and 16.1 (1) (b.1) of the Liquor Control and Licensing Regulation.

(2) This

section is repealed 60 days after the date on which this

section comes into force.
