5 The Act is amended by adding after

Section 12 of the Act is repealed and the following is substituted: 20 L’article 12 de la Loi est abrogé et remplacé par ce qui suit : 12(1) Subject to any order made under subsection (3), a beneficial disposition in favour of a witness who at ‐ tested the execution of the will or the witness’s spouse or common-law partner is void as against the witness, the witness’s spouse or common-law partner or any person claiming under any of them. 12(1)

Interpretation of will Interprétation du testament 15.01(1) A will must be interpreted in a manner that gives effect to the intent of the testator, and, in determin ‐ ing the testator’s intent, the court may admit the follow ‐ ing evidence: 15.01(1) Le testament s’interprète de telle manière à donner effet à l’intention du testateur et, afin de détermi ‐ ner quelle est celle-ci, le tribunal peut admettre des élé ‐ ments de preuve concernant ce qui suit : (

a) evidence as to the meaning, in either an ordinary or a specialized sense, of the words or expressions used in the will;

b) evidence as to the meaning of the provisions of the will in the context of the testator’s circumstances at the time of the making of the will; and

c) evidence of the testator’s intent with regard to the matters referred to in the will.

Change in circumstances Changement de circonstances 15.02(1) In this section, “common-law relationship” means the relationship between two persons who are common-law partners of each other. 15.02(1) Dans le présent article, « union de fait » s’en ‐ tend de la relation qui existe entre deux personnes qui sont les conjoints de fait l’une de l’autre. 15.02(2) Except as otherwise provided in this section, a will is not revoked by presumption of an intention to revoke it on the ground of a change in circumstances. 15.02(2) Sauf disposition contraire du présent article, un testament n’est pas révoqué par présomption d’une volonté de faire ainsi fondée sur un changement de cir ‐ constances. 15.02(3) Except when a contrary intention appears by the will or by a marriage contract or separation agree ‐ ment entered into between the testator and the testator’s former spouse, if, after the testator makes a will, the tes ‐ tator’s marriage is terminated by a judgment absolute of divorce or is declared a nullity, the following are re ‐ voked: 15.02(3) Sauf indication contraire manifestée dans un testament ou dans un contrat de mariage ou un accord de séparation conclu entre le testateur et son ancien con ‐ joint, la dissolution du mariage du testateur, par un juge ‐ ment irrévocable de divorce ou par une déclaration de nullité ayant lieu après la rédaction du testament, révo ‐ que : (

15.02(5) A spouse is deemed to be separated from the testator at the time of the testator’s death for the pur ‐ poses of subsection (4) if 15.02(5) Pour l’application du paragraphe (4), un con ‐ joint est réputé être séparé du testateur au moment du décès de ce dernier si, selon le cas : (

a) at the time of the death of the testator, they had been living separate and apart as a result of their mar ‐ riage breakdown for at least the immediately preced ‐ ing two-year period,

d) before the testator’s death, they divided their property in a manner that was intended by them, or appears to have been intended by them, to separate and finalize their affairs in recognition of their mar ‐ riage breakdown.
