MITCHELL First Reading Second Reading Committee of the Whole Third Reading Royal Assent Title: 1992 (22nd, 4th) Bill 214, Municipal Taxation Amendment Act Bill Mr. Mitchell BILL MUNICIPAL TAXATION AMENDMENT ACT (Assented to , 1992) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1 The Municipal Taxation Act is amended by this Act. 2

Section is amended by adding the following after subsection (5):

(6) Notwithstanding anything contained in this section, where an assessor is of the opinion that land has been contaminated as a result of activities carried out thereon by the owner, an assessor shall not have regard to the effect of such contamination on the fair actual value of the land and the land shall be assessed as if the contamination had not taken place. 3 This Act comes into force upon Proclamation. 1 Explanatory Notes This Bill will amend

Chapter M-31 of the Revised Statutes of Alberta. 2 This amendment will prevent a person who has contaminated land from receiving the benefit of a fair actual value for the land which is low due to the fact of the contamination. 1 Title: 1992 (22nd, 4th) Bill 214, Municipal Taxation Amendment Act
