OIC Text: The Governor in Council on the report and recommendation of the Minister of Finance dated July 29, 2009, and pursuant to

Section 20 of

Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, is pleased to determine that on, from and after the commencement of employment with the South Shore District Health Authority, the South West Nova District Health Authority, the Annapolis Valley District Health Authority, the Colchester East Hants Health Authority, the Cumberland Health Authority, the Pictou County Health Authority, the Guysborough Antigonish-Strait Health Authority, the Cape Breton District Health Authority or the Capital District Health Authority (the "Employers"), the following shall apply in relation to certain "bargaining unit employees" as defined in Memoranda of Agreement made by each Employer with the Province and the Nova Scotia Government and General Employees Union: (a)the bargaining unit employees listed in

Schedule "A" to each of the Memoranda of Agreement are deemed to continue to be persons employed in the public service of the Province for all purposes of the Public Service Superannuation Act, and the service by those bargaining unit employees with an Employer is deemed to be service in the public service of the Province for the purpose of the Public Service Superannuation Act; (b)with respect to all bargaining unit employees employed by an Employer after June 7, 2009 who meet the eligibility requirements for membership in the Public Service Superannuation Plan, their service with the Employer shall be deemed to be service in the public service of the Province for the purpose of the Public Service Superannuation Act; (c)each Employer shall deduct from the salary of the bargaining unit employees such amounts as are required under the Public Service Superannuation Act to be deducted from the salary of employees in the public service of the Province, and shall pay the same to the Minister of Finance, and such amounts when so received shall be paid into and form part of the Public Service Superannuation Fund established pursuant to the Public Service Superannuation Act; and (d)where by the Public Service Superannuation Act a matching payment is directed to be made into the Public Service Superannuation Fund by the Minister of Finance or where by that Act the superannuation allowance or other sum is directed to be paid out of the Consolidated Fund of the Province, then, in respect of a bargaining unit employee, the payment, superannuation allowance or other sum shall be paid by the applicable Employer and shall form part of the annual expenses of that Employer.\x0c
