B.C. Reg. 77/2021 , deposited March 15, 2021, under the PHARMACEUTICAL SERVICES ACT [sections 59 and 61]. Order in Council 159/2021, approved and ordered March 15, 2021.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Drug Plans Regulation, B.C. Reg. 73/2015, is amended as set out in the attached

Schedule 1,

(

b) the Provider Regulation, B.C. Reg. 222/2014, is amended as set out in the attached

Schedule 2,

(

c) paragraph (

b) of B.C. Reg. 181/2019 is amended by striking out "April 1, 2021" and substituting "October 1, 2021", and

(

d) effective August 31, 2021, the Drug Plans Regulation is amended as set out in the attached

Schedule 3.

Schedule 1

Section 26 of the Drug Plans Regulation, B.C. Reg. 73/2015, is amended

(

a) in subsection (2) by striking out " family unit's family net income for the current year is, or for the previous year was, " and substituting " family unit's gross income for the current year is, or family net income for the previous year was, ", and

(

b) in subsection (3) (

a) by striking out "

section 25 (2) (b) (v) " and substituting "

section 25 (2) (c) (v) ".

Section 36 (2) is amended by adding the following paragraphs:

(

i) a person, other than a director, who is a party to an agreement made under

section 12.3 of the Child, Family and Community Service Act ;

(

j) a person who is a dependent child of a person described in any of paragraphs (

f) to (

i) of this subsection.

Section 42 (2) is amended by striking out " medical practitioner or nurse practitioner " and substituting " practitioner ".

Schedule 2

Section 3.1 of the Provider Regulation, B.C. Reg. 222/2014, is amended

(

a) in subsection (3) by striking out " 6 months after the date this

section comes into force and ends March 31, 2021 " and substituting " January 19, 2020 and ends September 30, 2021 ", and

(

b) in subsection (4) by striking out " April 1, 2021 " and substituting " October 1, 2021 ".

Schedule 3

Section 36 (2) of the Drug Plans Regulation, B.C. Reg. 73/2015, is amended

(

a) by adding the following paragraph:

(i.1) a person who

(

i) is not in the custody of the person's parent within the meaning of the Child, Family and Community Service Act but is in the custody of another person, and

(ii) is under the supervision of a director under an interim order or a temporary custody order within the meaning of that Act; , and

(

b) in paragraph (

j) by striking out " paragraphs (

f) to (i) " and substituting " paragraphs (

f) to (i.1) ".
