B.C. Reg. 77/2016 , deposited March 15, 2016, under the TLA'AMIN FINAL AGREEMENT ACT [section 14]. Order in Council 170/2016, approved and ordered March 14, 2016.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective on the date the Tla'amin Final Agreement comes into effect, the attached Tla'amin Final Agreement Forest Compensation Regulation is made.

TLA'AMIN FINAL AGREEMENT FOREST COMPENSATION REGULATION

Definitions

1 In this regulation:

“Act” means the Tla'amin Final Agreement Act ;

“affected agreement” means a tree farm licence referred to in

section 14 (2) or (3) of the Act.

Compensation

(1) The compensation to which the holder of an affected agreement is entitled under

section 14 (7) (

a) of the Act is an amount equal to the value, for the unexpired portion of the term of the agreement, of the rights referred to in that

section under the agreement that are taken by a means referred to in that section.

(2) The compensation to which the holder of an affected agreement is entitled under

section 14 (7) (

b) of the Act in relation to an improvement referred to in that

section is an amount equal to the value of the improvement.
