SCHEDULE 1

ORDER

Special Provisions for the Organization and Operation of

The Municipal District of Mackenzie No. 23

Definitions

1 In this Order,

(a) "Act" means the Municipal Government Act;

(b) "Minister" means the Minister of Municipal Affairs;

(c) "new municipality" means the specialized municipality named "The Municipal District of Mackenzie No. 23";

(d) "old municipality" means the municipal district named "The Municipal District of Mackenzie No. 23" formed by Order in Council numbered O.C. 757/94;

(e) "official administrator" means the official administrator appointed by the Minister under

section 575 of the Municipal Government Act to supervise The Municipal District of Mackenzie No. 23 and its council.

Specialized Municipality

(1) The status of the old municipality is changed to a specialized municipality to address concerns about municipal government and management in a municipality that serves a number of unique communities within a very large territory.

(2) The provisions of the Municipal Government Act and other enactments are modified to the extent necessary to accomplish the intent of this order.

Transitional Authority

(1) The council of the old municipality is dismissed.

(2) The official administrator has all the powers and duties of council of the new municipality until the organizational meeting following its first general municipal election.

(3) The Minister may, by order, establish and appoint an interim advisory council for the new municipality to advise the official administrator until the organizational meeting following the first municipal general election.

First Municipal General Election

(1) The date for the first municipal general election for the new municipality is October 18, 1999.

(2) The returning officer for the first municipal general election is the official administrator.

(3) This

section modifies

section 7 of the Local Authorities Election Act.

Municipal Council Structure

(1) The council of the new municipality is to be comprised of 10 councillors.

(2) The new municipality is divided into 10 wards described in

Schedule 2 with one councillor to be elected from each ward.

(3) The chief elected official is to be appointed by council from among the councillors.

(4) The council of the new municipality may not pass bylaws referred to in sections 148 and 150 of the Act.

Official Administrator

(1) In this section, "council" means the council of the new municipality established under its first municipal general election.

(2) The powers of the official administrator under

section 575(2) of the Act apply to the resolutions and bylaws of the council.

(3) Ministerial Orders numbered 252/99 and 34/99 apply to the council.

(4) Despite

section 574(1) of the Act, the Minister may by order direct the council, the chief administrative officer or a designated officer of the new municipality to take any action that the Minister considers proper in the circumstances.

(5) Section 574(2) to (6) of the Act apply to an order made under subsection (4) of this section.

(6) The appointment of the official administrator ends on November 1, 2001.

Status Changes Back to Municipal District

(1) The status of the new municipality is changed to a municipal district on November 1, 2001.

(2) Sections 78 and 93 to 95 of the Act do not apply to the change of status under subsection (1).

(3) The council of the municipal district is to be comprised of 10 councillors.

(4) The municipal district is divided into 10 wards described in

Schedule 2 with one councillor to be elected from each ward.

The reasons for the designation are as follows:

The historical significance of the railway station and water tower in Heinsburg relate to the roll of the community as a service centre at the end of the Coronado Branch line of the CN Railway during the middle part of the century. It served a vast area of agricultural, reserve and Metis settlement land to the north, west and south. Such railway stations were standard features of small town Alberta, of which many examples have survived. The water tower, in its original location with the retention of the original tank and piping system, is unique to the province.

It is therefore considered that the preservation and protection of the resource is in the public interest.

In 1997 authorized interceptions continued to be a valuable investigative tool. Typically employed in investigations of allegations of murders, robberies and other serious offences, authorized interceptions provide valuable information which would otherwise be inaccessible. This year's statistics would indicate that more interceptions were carried out at temporary residences or commercial premises than permanent residences.

Overall there was an increase in the number of applications this year for interceptions however, the number of applications that were actually granted is only slightly higher than in previous years.

In 1997, 42 applications were sought and 30 were granted. By comparison in 1996, only 21 applications were sought and 19 were granted. In 1995, 33 applications were sought.

It would appear that the 1996 year is somewhat of an aberration and that 1997 is a return to similar numbers granted in earlier years although 1994 still exceeds 1997 in that 50 authorizations were sought

Of the 30 authorizations granted, 132 matters went to court. Unfortunately, at this point in time, there are no resulting convictions. It should be noted however that many of these matters are still pending1.

This year only 1 investigational use of an authorized intercepted communication did not result in criminal proceedings. This is consistent with past years when there has been a sharp decline in the investigational use of authorized intercepted communications which were not adduced in evidence.

Authorized interceptions continued as an invaluable investigative tool. They continue to be employed in investigations involving allegations of murder, robberies, kidnapping, conspiracy and drug offences. They provide valuable information which would otherwise be inaccessible.

While there is a greater variation of where interceptions take place, the permanent residence continues to be in the majority.

As in previous years, the numbers of authorizations are becoming fewer yet they do result in charges and in convictions. It should be noted that the gathering of these statistics does not account for cases which are pending before the courts. At least two jurisdictions provided that there are cases pending.

Finally, at least one police force noted the rising cost of disclosure in respect of this type of evidence must be considered in the overall cost of the investigation. Cost of disclosure is not offset by increases to the budget and thereby the overall investigative usefulness is reduced.
