OIC Text: The Governor in Council on the report and recommendation of the Minister of Finance and Treasury Board dated July 6, 2017, and pursuant to Sections 26 and 29 of

Chapter 2 of the Acts of 2010, the Finance Act (the Act), and pursuant to the report of the Minister of Finance and Treasury Board that states: (

a) that the expenditures in the amounts set forth in

Schedule “A” hereto are urgently and immediately required for the public good pending the granting of the appropriations by the Legislature for the fiscal year ending March 31, 2018, to provide for defraying charges and expenses of the public service of the Province for the fiscal year ending March 31, 2018; (

b) that other than as contained in

Section 26 of the Act, which provides the payments for any service shall not exceed fifty per cent of the previous year’s appropriation, there is no legislative provision for the payment of the said amounts; (

c) that the Legislature is not in session; (

d) the Minister of Finance and Treasury Board therefore recommends that pursuant to

Section 29 of the Act, the Governor in Council be pleased to order a Special Warrant to be prepared, to be signed by the Lieutenant Governor, for the issue of the amounts set forth in

Schedule “A” hereto for the fiscal year ending March 31, 2018; (

e) the said several sums shall be paid by the Minister of Finance and Treasury Board, subject to the provisions of the statutes in that behalf, out of the monies that are applicable to the several purposes for which the said several sums are granted; (

f) that when the Legislature enacts legislation to provide for defraying certain charges and expenses of the public service for the Province, likely to be known as the Appropriations Act, 2017 , such amounts authorized to be spent pursuant to the Special Warrant issued hereto shall be included in, and not in addition to, the amounts authorized to be spent pursuant to that Act; is pleased to authorize the issuance of a Special Warrant to be prepared and to be signed by the Lieutenant Governor, for the issue of the amounts set forth in

Schedule “A” attached hereto and forming part of the Report and Recommendation for the fiscal year ending March 31, 2018.
