An Act to Amend the Parks Act Loi modifiant la

Loi sur les parcs Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l'avis et du consentement de l'Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 1 of the Parks Act,

chapter P-2.1 of the Acts of New Brunswick, 1982, is amended by repealing the definition “Minister” and substituting the following: 1 L’article 1 de la

chapitre P-2.1 des Lois du Nouveau-Brunswick de 1982, est modifié par l’abrogation de la définition « Ministre » et son rempla- cement par ce qui suit : “Minister” means « Ministre » désigne (

a) in relation to the provincial parks listed in Sched- ule A, the Minister of Tourism and Parks, or

a) relativement aux parcs provinciaux énumérés à l’Annexe A, le ministre du Tourisme et des Parcs; (

b) in relation to all other provincial parks, the Min- ister of Natural Resources;

b) relativement à tous les autres parcs provinciaux, le ministre des Ressources naturelles; 2 Subsection 3(2) of the Act is amended in the portion following paragraph (

g) by striking out “has an area of less than twenty hectares, or”. 2 Le paragraphe 3(2) de la Loi est modifié au passage qui suit l’alinéa g), par la suppression de « est inférieur à cinquante acres et ». 3

Section 8 of the Act is amended by adding after sub- section (4) the following: 3 L’article 8 de la Loi est modifié par l’adjonction après le paragraphe (4) de ce qui suit : 8(5) Notwithstanding subsection (4), the Minister may, without the approval of the Lieutenant-Governor in Coun- cil, grant an easement in perpetuity across a recreational trail that has been designated as a provincial park if the easement is for the purposes of accessing land adjacent to the trail or is for the purposes of the installation or main- tenance of above or below ground utilities. 8(5) Nonobstant le paragraphe (4), le Ministre peut, sans l’approbation du lieutenant-gouverneur en conseil, accor- der une servitude à perpétuité qui traverse un sentier de loisirs désigné comme parc provincial si la servitude a pour objet de permettre l’accès à un bien-fonds adjacent au sen- tier ou si elle a pour objet de permettre la mise en place ou l’entretien d’installations en surface ou souterraines pour les services publics. 1

Section 1 The existing provision is as follows:

Section 2 The existing provision is as follows:

Article 2 Texte de la disposition actuelle : 3(2) The Lieutenant-Governor in Council 3(2) Le lieutenant-gouverneur en conseil (

a) may authorize the Minister to purchase or acquire any land, whether or not covered with water, for the purpose of development as a provincial park;

b) notwithstanding any other Act, may authorize the Minister to enter into an agreement with

c) may authorize the Minister to increase or decrease the area of any provincial park;

e) may terminate the status of any provincial park;

f) may authorize the Minister to dispose of any buildings, in- stallations or improvements, or all or any part of the land included in a provincial park, as he sees fit; and
