B.C. Reg. 47/2010 , deposited March 1, 2010, pursuant to the ADOPTION ACT [Sections 80, 91 (2) (
q) and (u)] and the FINANCIAL ADMINISTRATION ACT [Section 19]. Order in Council 103/2010, approved and ordered March 1, 2010.
On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective April 1, 2010,
(
a) section 5 of the Adoption Fees Regulation, B.C. Reg. 293/96, is repealed and the following substituted:
Remission of fees
(1) Approval of the Lieutenant Governor in Council is given for the remission of the obligation to pay any fee under this regulation if, in respect of the person who must pay the fee, the family unit of which that person is a part has, in the current calendar year, a before-tax annual income equal to or less than the low-income measures established by Statistics Canada for the most recent calendar year for family units of that size plus 10%.
(2) If a person must pay more than one fee under this regulation, "fee" for the purpose of subsection (1) means the sum of all fees payable by that person under this regulation. , and
(
b) the Adoption Regulation, B.C. Reg. 291/96, is amended as set out in the attached Schedule.

Section 25 of the Adoption Regulation, B.C. Reg. 291/96, is repealed and the following substituted:
Remission of fees
(1) Approval of the Lieutenant Governor in Council is given for the remission of the obligation to pay any fee under this
Part if, in respect of the person who must pay the fee, the family unit of which that person is a part has, in the current calendar year, a before-tax annual income equal to or less than the low-income measures established by Statistics Canada for the most recent calendar year for family units of that size plus 10%.
(2) If a person must pay more than one fee under this Part, "fee" for the purpose of subsection (1) means the sum of all fees payable by that person under this Part.
2 The definition of "designated child" in
section 26 is amended by adding the following paragraph:
(b.1) was, after November 4, 1996, adopted under the Adoption Act and is under the guardianship of a person who is a guardian under the Family Relations Act or the Infants Act , .
Section 27 (1), (2) and (3) is repealed and the following substituted:
(1) A person is eligible for financial assistance or other assistance under
section 80 of the Act if
(
a) the person
(
i) proposes to adopt or has, after November 4, 1996, adopted a child who comes within paragraphs (a), (
b) and (
c) of the definition of "designated child" , or
(ii) is a guardian under the Family Relations Act or the Infants Act of a child who comes within paragraphs (a), (b.1) and (
c) of the definition of "designated child" , and
(
b) has a demonstrated need for one or more of the services described in
section 28 (1) (
b) or (c).
(2) A person referred to in subsection (1) May apply to a director for financial assistance or other assistance on the form specified by the director.
Section 27.1 is repealed.
Section 28 (1) (
b) is repealed and the following substituted:
(
b) direct service support or payment for services related to the special needs of the designated child; .
Section 30.1 (2), (3) and (4) is amended by striking out " in accordance with sections 27 (2) and (3), " and substituting " in accordance with sections 27 (2), ".
