Melmerby Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 77-913 (July 26, 1977), N.S. Reg. 73/77

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 4th day of July, A. D., 1977, and pursuant to the Provincial Parks Act ,

Revised Statutes of Nova Scotia, 1967,

Chapter 244,

Section 2, is pleased to:

(

a) constitute all that area of land including land covered with water owned by Her

Majesty in right of the Province of Nova Scotia, situate at or near Little

Harbour, in the County of Pictou, Province of Nova Scotia, to be a Provincial

Park, said area of land being described in

Schedule “A” and shown outlined in

red on

Schedule “B”, both attached to and forming part of the report and

recommendation; and

(

b) declare that the name of the park shall be known as Melmerby Beach

Provincial Park.

Schedule “A”

All that certain lot, piece or parcel of land situate, lying and being at or near Little Harbour, in

the County of Pictou, Province of Nova Scotia, as shown on Plan No. E-5-53, recorded at the

Crown Land Records Office, Department of Lands and Forests, Halifax, the said lot being more

particularly described as follows:

Beginning at Crown Land Iron Post (C.L.I.P.) No. 1521 set on the northeastern boundary of the

road leading from Roy’s Island, the said iron post being the southwestern corner of lands now

or formerly owned by J. Stanley Fraser;

From thence (by grid bearings based on the Nova Scotia Three Degree Transverse Mercator

Projection, Zone 4, Central Meridian sixty-one degrees thirty minutes west longitude) south

eighty-five degrees forty-eight minutes west, nine decimal zero five chains to C.L.I.P. No.

1435;

Thence north eighty-seven degrees five minutes west, five decimal six one chains to an iron

post;

Thence north sixty-nine degrees thirty-five minutes west, one decimal six chains, more or less,

to a point on the mean high water mark of Little Harbour;

Thence generally northerly, northwesterly, southwesterly, northwesterly , northerly and easterly

along the various courses of the mean high water mark of Little Harbour and Northumberland

Strait (the mean high water mark circumscribing a western portion of the mainland, the

southwestern side of the causeway leading from Roy’s Island to the mainland and the southern,

western and a portion of the northern side of Roy’s Island) a total distance of three hundred

twelve chains, more or less, to the northwest corner of lands of Ronald L. Wilsack as shown on

said Plan No. E-5-53;

Thence south twenty-two degrees twenty-two minutes seven seconds east, fifty feet more or

less, along the southwestern boundary of lands of Ronald L. Wilsack to C.L.I.P No. 5397;

Thence continuing south twenty-two degrees twenty-two minutes seven seconds east two

hundred fifty-seven decimal two three feet, along the southwestern boundary of lands of Ronald

L. Wilsack to C.L.I.P No. 5398 set on the northwest boundary of a twenty foot wide

right-of-way;

Thence north sixty-seven degrees thirty-eight minutes fifty-five seconds east, one hundred fifty

decimal zero six feet along the northwest boundary of the twenty foot wide right-of-way to

C.L.I.P. No. 5395;

Thence north twenty-two degrees twenty-two minutes seven seconds west, two hundred

forty-eight decimal one nine feet along the northeast boundary of lands of Ronald L. Wilsack to

C.L.I.P. No. 5396 situate south sixty-nine degrees forty-three minutes five seconds east, eight

thousand nine hundred twenty-eight decimal nine eight feet from Nova Scotia Co-ordinate

Monument No. 3578 having co-ordinates (N 16, 598, 931.37 E 731, 278.22);

Thence continuing north twenty-two degrees twenty-two minutes seven seconds west, fifty

feet, more or less, along the northeast boundary of lands of Ronald L. Wilsack to a point on the

mean high water mark of Northumberland Strait;

Thence in an easterly direction along the various courses of the mean high water mark of

Northumberland Strait a distance of two hundred ninety feet, more or less, to a point marking

the northwest corner of lands of John W. MacLeod;

Thence south twenty-two degrees seventeen minutes three seconds east fifty feet, more or less,

along a southwest boundary of lands of John W. MacLeod to C.L.I.P. No. 5406;

Thence continuing south twenty-two degrees seventeen minutes three seconds east one hundred

fifty-seven decimal two three feet, along a southwest boundary of lands of John W. MacLeod to

C.L.I.P. No. 5405 set on the northwestern boundary of the aforesaid twenty-foot wide

right-of-way;

Thence continuing south twenty-two degrees seventeen minutes three seconds east, twenty feet,

more or less, to the southeastern boundary of the aforesaid twenty-foot wide right-of-way;

Thence north sixty-seven degrees thirty-eight minutes fifty-five seconds east, twenty feet along

the southeastern boundary line of the aforesaid twenty foot wide right-of-way to C.L.I.P. No.

5394;

Thence south twenty-two degrees seventeen minutes three seconds east, one hundred

seventy-four decimal two two feet, along a southwestern boundary line of lands of John W.

MacLeod to C.L.I.P. No. 5404;

Thence in a northeasterly direction along the southeastern boundary of Lots C, B, 1, 2 and 5 as

shown on said Plan No. E-5-53, a distance of eight decimal eight chains, more or less, to a

point on the mean high water mark of Northumberland Strait;

Thence running in a southeasterly direction along the mean high water mark of

Northumberland Strait (the mean high water mark circumscribing the northeastern side of the

causeway joining Roy’s Island with the mainland) a distance of ninety-seven chains, more or

less, to a point situate north one degree thirty-five minutes east, two decimal two nine chains

from the northeastern corner of lands now or formerly owned by J. Stanley Fraser;

Thence south one degree thirty-five minutes west, two decimal two nine chains to an iron bar

marking the northeastern corner of lands now or formerly owned by J. Stanley Fraser;

Thence north seventy-eight degrees thirty-six minutes west, three decimal four five chains

along the northern boundary of the said lands now or formerly owned by J. Stanley Fraser to an

iron bar;

Thence south twenty-six degrees two minutes west, six decimal four nine chains along the

northwesterly boundary of the said lands now or formerly owned by J. Stanley Fraser to the

place of beginning.

The above described lands containing 250 acres, more or less.

Excepting and reserving from the above described lands a parcel of land containing 1.49

acres, more or less, being and intended to be Lots 7, 5 and 4/9 of Lot 3, the same being now or

formerly owned by William E. Fraser and shown in inset “A” on the said Crown Land Records

Plan No. E-5-53, the said parcel being more particularly described as follows:

Beginning at Crown Land Iron Post (C.L.I.P.) No. 5392 set on the southeastern boundary line

of the before mentioned twenty-foot wide right-of-way running along the southeastern boundary

line of lands of Ronald L. Wilsack, the said iron post being southeast of C.L.I.P. No. 5395 and

on the prolongation of the northeast boundary of lands of Ronald L. Wilsack;

From thence (by grid bearings based on the Nova Scotia Three Degree Transverse Mercator

Projection, Zone 4, Central Meridian sixty-one degrees thirty minutes west longitude) north

sixty-seven degrees thirty-eight minutes fifty-five seconds east, two hundred twenty decimal

zero nine feet along the southeastern boundary of the said right-of-way to C.L.I.P. No. 5393;

Thence south twenty-two degrees seventeen minutes three seconds east, two hundred twelve

decimal six seven feet to C.L.I.P. No. 5402 set on the northwestern boundary of a second

twenty foot wide right-of-way;

Thence south thirty-eight degrees thirty-four minutes thirty-nine seconds west, forty-five

decimal seven five feet along the northwestern boundary of the said second right-of-way to

C.L.I.P. No. 5401;

Thence south seventeen degrees, forty-one minutes fifty-three seconds west, one hundred

thirty-nine decimal eight two feet along the northwestern boundary of the said second

right-of-way to C.L.I.P. No. 5400;

Thence south eighty-one degrees twenty-two minutes forty-three seconds west, ninety-two

decimal six two feet along the northern boundary of the said second right-of-way to C.L.I.P. No.

5399;

Thence north twenty-two degrees twenty minutes nine seconds west three hundred nineteen

decimal nine four feet to the place of beginning.
