CHAPTER

An Act to amend The Surrogate Court Act (Assented to March 31, 1981) HER MAJESTY, by and with the advice and consent of th e Legislative Assembly of Saskatchewan, enacts as follows:

Short title This Act may be cited as The Surrogate Court Amendment Act, 1981. Rev. Stat. c.S-66,

section amended Subsection 45(1) of The Surrogate Court Act is repealed and the following substituted: “

(1) Where the value of the property of a deceased does not exceed $5,000 and probate of a will or letters of administration are sought by any individual who: (

a) is a resident of Saskatchewan; (

b) is a person acting on his own behalf; and (

c) is a person, other than a creditor, entitled to seek probate of the will or letters of administration; the local clerk shall, on demand of that individual, prepare the necessary papers leading to grant, including all papers and proofs required by The Succession Duty Act, 1972 or by any other Act of the Parliament of Canada or the Legislature of Saskatchewan relating to the payment of estate taxes or succession duties and the bond, if any, and administer the necessary oaths”.
