OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal, dated October 31, 2017, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act , and pursuant to
Section 80 of
Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Parcel OCR-lA, Parcel OCR-1B, Parcel OCR-1C, Parcel OCR-2, Parcel OCR-3, Parcel OCR-4, Parcel OCR-5 and Parcel OCR-6, containing a total area of 126,535 square feet (2.9 acres), more or less, a portion of the Old Cobequid Road, located at or near Dartmouth, Halifax County, more particularly described in
Schedule “A” and shown on
Schedule “B” attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of the parcels of surplus land being: Parcel OCR-1A and Parcel OCR-3 to W.
Eric Whebby Limited, a body corporate with its registered office at 105 Lethbridge Avenue, Dartmouth, Halifax County, Nova Scotia and Frank Whebby Limited, a body corporate with its registered office at 377 Waverley Road, Dartmouth, Halifax County, Nova Scotia; Parcel OCR-1B to Terrance Michael Murphy of Dartmouth, Halifax County, Nova Scotia; Parcel OCR-1C to John Harnish and Susan Farrell both of Dartmouth, Halifax County, Nova Scotia; Parcel OCR-2 to Vivian Georgena Taylor and Robert Corey Taylor both of Dartmouth, Halifax County, Nova Scotia; Parcel OCR-4 to Jose M.
Barreiro of Dartmouth, Halifax County, Nova Scotia; Parcel OCR-5 and Parcel OCR-6 to Port Wallace Holdings Limited, a body corporate with its registered office at 255 Lacewood Drive, Halifax, Halifax County, Nova Scotia; for the consideration of $124,004.30 plus HST of $18,600.64 for a total purchase price of $142,604.94; (
c) authorize the Minister of Transportation and Infrastructure Renewal to make and execute Deeds of Conveyance in such form as the Minister determines to affect the conveyance of the lands herein above described; and (
d) authorize the Minister of Transportation and Infrastructure Renewal to execute such documents as may be necessary to achieve the purpose of the Order.
