OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal dated July 21, 2015, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act , and
Section 11 of
Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act , is pleased to: (
a) extinguish the right of the public to use surplus sections of a public highway located at Highway 104 and Trunk 7, West River, County of Antigonish, identified as “Lot 15-1”, “Parcel B”, and “Parcel C” on the plan marked
Schedule “A” attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of “Lot 15-1”, “Parcel B”, and “Parcel C” to Nova Construction Co. Ltd., a body corporate, with its registered office at 3098 Post Road, Antigonish, Nova Scotia, in exchange for the consideration of $95,522.00 and the conveyance to Her Majesty in the Right of the Province of Nova Scotia of lands at West River identified as “Parcel A” on
Schedule “A” attached to and forming part of the Report and Recommendation; and (
c) authorize the Minister of Transportation and Infrastructure Renewal to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein above described.
