Schooner Pond Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 77-127 (February 8, 1977), N.S. Reg. 23/77

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 7th day of January, A.D., 1977, pursuant to

Section 5(1) of

Chapter 6 of the

Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high water mark of

Schooner Pond Beach, in the County of Cape Breton, Province of Nova Scotia, as shown

outlined in red on the copy of Crown Land Records Office Plan No. E-10-68, marked

Schedule

“B”, and described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high water mark of Schooner Pond

Beach, in the County of Cape Breton, Province of Nova Scotia as shown outlined in red on the

copy of Crown Land Records Office Plan No. E-10-68, attached hereto and being more

particularly described as follows:

Beginning at Crown Land Survey Post No. C.B. 2423 situated south fifty-eight degrees

twenty-two minutes fifty-one decimal four seconds east one hundred twenty-two decimal two

zero three feet from Crown Land Survey Post No. C.B. 2398 marking the southwest angle of

the Fisherman’s Reserve so-called; said post No. C.B. 2423 having coordinates

(Northing 16, 786, 041.753, Easting 1, 419, 438.446) based on the Nova Scotia Coordinate

System, Three Degree Transverse Mercator Projection, Zone 4, Central Meridian sixty-one

degrees thirty minutes west longitude;

From Thence (by grid bearings) north eighty-two degrees thirty-three minutes twenty-nine

decimal nine second: west, four hundred ninety-three decimal five five one feet to Crown Land

Survey Post No. C.B. 2422 having coordinates (N 16, 786, 105.676, E 1, 418, 949.052):

Thence north forty-six degrees forty-one minutes nine decimal eight seconds west, four

hundred sixty-six decimal nine nine eight feet to Crown Land Survey Post No. C.B. 2421

having coordinates (N 16, 786, 426.035, E 1, 418, 609.261);

Thence north eighty-six degrees forty-six minutes nine decimal nine seconds east, crossing the

waters of Schooner Cove one thousand seven hundred ninety-five decimal zero six two feet

Crown Land Survey Post No. C.B. 2424 having coordinates

(N 16, 786, 527.195, E 1, 420, 401.470);

Thence south sixty-three degrees fourteen minutes fifty-three decimal six seconds west, one

thousand seventy-eight decimal four five seven feet to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high water mark.
