1 2009 BILL 53 Lobbyists Registration Act

WHEREAS free and open access to government is an important matter of public interest; AND

WHEREAS lobbying public office holders is a legitimate activity; AND

WHEREAS it is desirable that public office hold- ers and the public be able to know who is engaged in lob- bying activities; AND

WHEREAS a system for the registration of paid lobbyists should not impede free and open access to gov- ernment;

NOW THEREFORE, Her Majesty, by and with the ad- vice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

INTERPRETATION 1 The following

definitions apply in this Act. “lobbyist” means to communicate with a public office holder in an attempt to influence (

a) the development of any legislative proposal by the Government of New Brunswick or by a member of the Legislative Assembly, PROJET DE LOI 53

b) the introduction of any bill or resolution in the Legislative Assembly or the passage, defeat or amend- ment of any bill or resolution that is before the Legisla- tive Assembly, (

c) a decision by the Executive Council to transfer from the Crown for consideration all or part of, or any interest in or asset of, any business, enterprise or insti- tution that provides goods or services to the Crown or to the public, (

d) a decision by the Executive Council, a committee of the Executive Council or a minister of the Crown to have the private sector instead of the Crown provide goods or services to the Crown, (

e) the awarding of any grant, contribution or other financial benefit by or on behalf of the Crown. (lobbyistes) “organization” means (

a) a business, trade, industry, professional or volun- tary organization, (

b) a trade union or labour organization, (

c) a chamber of commerce or board of trade, (

d) an association, a charitable organization, a coali- tion or an interest group, (

e) a government, other than the Government of New Brunswick, and (

f) a corporation without share capital incorporated to pursue, without financial gain to its members, objects of a national, provincial, territorial, patriotic, religious, philanthropic, charitable, educational, agricultural, sci- entific, artistic, social, professional, fraternal, sporting or athletic character or other similar objects. (organisa- tion) “prescribed” means prescribed by the regulations made under this Act. (prescrit) “public office holder” means (

a) a member of the Legislative Assembly and any person on his or her staff,

d) toute décision du Conseil exécutif, d’un de ses co- mités ou d’un ministre de la Couronne de charger le secteur privé plutôt que la Couronne de la fourniture de biens ou de services à celle-ci,

e) l’octroi de subventions, de contributions ou d’autres avantages financiers par la Couronne ou pour son compte. (lobbyist) « organisation » S’entend de ce qui suit :

a) une organisation commerciale, industrielle, pro- fessionnelle ou bénévole;

b) une organisation syndicale;

c) une chambre de commerce;

d) une association, un organisme de bienfaisance, une coalition ou un groupe d’intérêt;

e) un gouvernement autre que celui de la province Nouveau-Brunswick;

f) une personne morale sans capital-actions consti- tuée en vue de poursuivre, sans gain pécuniaire pour ses membres, des objets d’un caractère national, pro- vincial, territorial, patriotique, religieux, philanthropi- que, charitable, éducatif, agricole, scientifique, artisti- que, social, professionnel, fraternel, sportif ou athlétique ou des objets analogues. (organization) « prescrit » Prescrit par les règlements pris en applica- tion de la présente loi. (prescribed) « registraire » Le registraire nommé en vertu de l’arti- cle 8. (registrar)

b) an officer, director or employee of any agency, board or commission of the Crown. ( titulaire d’une charge publique) “registrar” means the registrar appointed under

section 8. (registraire) “return” means the information required by the regis- trar under subsection 4(2). (déclaration) Application 2 This Act binds the Crown. 3(1) This Act does not apply to any of the following per- sons when acting in their official capacity: (

a) members of the Senate or House of Commons of Canada, the legislative assembly of another province, the council or legislative assembly of a territory, or per- sons on the staff of these members; (

b) employees of the Government of Canada or of the government of another province or of a territory; (

c) members of a council or other statutory body charged with the administration of the civil or munici- pal affairs of a municipality. 3(2) This Act does not apply in respect of (

a) any oral or written submission made in proceed- ings that are a matter of public record to a committee of the Legislative Assembly or to any body or person hav- ing jurisdiction or powers conferred by or under

an Act, (

b) any oral or written submission made to a public office holder by an individual on behalf of a person, partnership or organization, with respect to (

i) the enforcement,

interpretation or application of any Act or regulation made under any Act by that public office holder and with respect to that person, partnership or organization, or « titulaire d’une charge publique » S’entend des per- sonnes suivantes :

a) les sénateurs, les députés fédéraux, les députés d’une autre province, les conseillers ou les députés ter- ritoriaux, ainsi que leur personnel;

b) les employés du gouvernement du Canada ou de celui d’une autre province ou d’un territoire;

c) les membres d’un conseil ou autre organisme créé par une loi et chargé de la conduite des affaires munici- pales. 3(2) La présente loi ne s’applique pas à l’égard de ce qui suit :

a) la présentation d’observations orales ou écrites, dans le cadre de procédures dont l’existence peut être connue du public, soit à un comité de l’Assemblée lé- gislative, soit à une personne ou à un organisme dont la compétence ou les pouvoirs sont conférés sous le ré- gime d’une loi;

b) la présentation d’observations orales ou écrites par un particulier pour le compte d’une personne, d’une so- ciété en nom collectif ou en commandite ou d’une or- ganisation au titulaire d’une charge publique à l’égard de ce qui suit : (

i) soit l’exécution, l’interprétation ou l’applica- tion, par le titulaire de la charge publique, d’une loi ou d’un de ses règlements d’application dans le cas de la personne, de la société ou de l’organisation,

Loi sur l’enregistrement des lobbyistes (ii) the implementation or administration of any policy, program, directive or guideline by that public office holder and with respect to that person, part- nership or organization. Registration of Lobbyists 4(1) A lobbyist shall file a return with the registrar not later than 10 days after being requested in writing by the registrar to do so. 4(2) A lobbyist shall set out in the return the following information: (

a) the name and business address of the lobbyist and, if applicable, the name and business address of the firm where the lobbyist is engaged in business; (

b) the name and business address of the client and the name and business address of any person, partner- ship or organization that, to the knowledge of the lob- byist, controls or directs the activities of the client and has a direct interest in the outcome of the lobbyist’s ac- tivities on behalf of the client; (

c) if the client is a corporation, the name and busi- ness address of each subsidiary of the corporation that, to the knowledge of the lobbyist, has a direct interest in the outcome of the lobbyist’s activities on behalf of the client; (

d) if the client is a corporation that is a subsidiary of any other corporation, the name and business address of that other corporation; (

e) if the client is a coalition, the name and business address of each partnership, corporation or organiza- tion that is a member of the coalition; (

f) if the client is funded, in whole or in part, by a government, the name of the government or govern- ment agency, as the case may be, and the amount of funding received by the client from that government or government agency; (

g) such additional information as may be prescribed with respect to the identity of a person or entity de- scribed in this section. a) son nom et l’adresse de son établissement ainsi que, le cas échéant, le nom du cabinet où il exerce ses activités et l’adresse de son établissement;

b) le nom et l’adresse de l’établissement de son client ainsi que le nom et l’adresse de l’établissement de toute personne, société en nom collectif ou en commandite ou organisation qui, à sa connaissance, contrôle ou di- rige les activités de ce client et que le résultat de ses ac- tivités pour le compte de celui-ci intéresse directement;

c) dans le cas où son client est une personne morale, le nom et l’adresse de l’établissement de chacune de ses filiales que, à sa connaissance, le résultat de ses ac- tivités pour le compte de celui-ci intéresse directement;

d) dans le cas où son client est une personne morale filiale d’une autre personne morale, le nom et l’adresse de l’établissement de celle-ci;

e) dans le cas où son client est une coalition, le nom et l’adresse de l’établissement des sociétés en nom col- lectif ou en commandite, personnes morales ou organi- sations qui la composent;

f) dans le cas où le financement de son client provient en tout ou en

partie d’un gouvernement, le nom du gou- vernement ou de l’organisme gouvernemental, selon le cas, et les montants en cause;

g) toute information supplémentaire tel que prescrite en ce qui concerne l’identité d’une personne ou entité décrite dans le présent article.

5 Lobbyists Registration Act Bill 53 4(3) A lobbyist shall provide the registrar with any change to the information in his or her return and any in- formation required to be provided under subsection (4), the knowledge of which the lobbyist acquired only after the return was filed, not later than 30 days after the change occurs or the knowledge is acquired. 4(4) A lobbyist shall provide the registrar with confir- mation of the information contained in his or her return within 2 months after the expiration of the first and each subsequent year from the date of filing the return. 4(5) A lobbyist shall provide the registrar with any in- formation that the registrar may request to clarify any in- formation that the consultant lobbyist has provided to the registrar under this

section not later than 30 days after the registrar makes the request. 4(6) This

section does not apply in respect of anything that an employee undertakes to do on the sole behalf of his or her employer or, if his or her employer is a corporation, in respect of anything that the employee, at the direction of the employer, undertakes to do on behalf of any subsid- iary of the employer or any corporation of which the em- ployer is a subsidiary.

Certification, Submission and Storage of Returns and Other Documents 5 Every individual who submits a return or other docu- ment to the registrar under this Act shall certify that the in- formation contained in it is true to the best of his or her knowledge and belief on the return or other document or, if it is submitted in electronic or other form in accordance with subsection 9(1), in the manner that is specified by the registrar. 6 Returns to be filed with the registrar and information and other documents to be given to the registrar under this Act must be in a form approved by the registrar. 7 Any return or other document that is received by the registrar may be entered or recorded by any information storage device, including any system of mechanical or electronic data processing, that is capable of reproducing the stored return or other document in intelligible form within a reasonable time. 4(3) Le lobbyiste fournit au registraire, dans les trente jours, tout changement des renseignements que contient sa déclaration ainsi que tout renseignement qu’il est tenu de fournir aux termes du paragraphe (4) et qui n’a été porté à sa connaissance qu’après le dépôt de celle-ci. 4(4) Dans les deux mois de la fin de chaque année qui suit la date de dépôt de sa déclaration, le lobbyiste con- firme au registraire les renseignements qu’elle contient. 4(5) Dans les trente jours de la demande, le lobbyiste fournit au registraire les renseignements que celui-ci lui demande pour apporter des précisions à ceux qu’il a four- nis aux termes du présent article. 4(6) Le présent

article ne s’applique pas à l’égard de l’engagement qu’un employé exécute uniquement pour le compte de son employeur ni, dans le cas où l’employeur est une personne morale et où l’employé agit à sa de- mande, de l’engagement qu’il exécute pour le compte d’une filiale de l’employeur ou d’une personne morale dont celui-ci est une filiale.

Attestation, remise et mise en mémoire des déclarations et autres documents 5 Quiconque remet une déclaration ou un autre docu- ment au registraire aux termes de la présente loi atteste que les renseignements qui y figurent sont véridiques au mieux de sa connaissance et de ce qu’il tient pour tel, soit sur la déclaration ou le document même, soit, dans le cas où ils sont remis sous forme électronique ou autre confor- mément au paragraphe 9(1), de la manière que précise le registraire. 6 Les déclarations qui doivent être déposées auprès du registraire et les renseignements et autres documents qui doivent lui être remis aux termes de la présente loi le sont sous la forme qu’il approuve. 7

Sous réserve des règlements, les déclarations et les autres documents que reçoit le registraire peuvent être sai- sis ou enregistrés à l’aide d’un système de mise en mé- moire de l’information, notamment un procédé mécani- que ou électronique de traitement des données, qui peut les restituer sous une forme compréhensible dans un délai raisonnable.

Loi sur l’enregistrement des lobbyistes Registrar and Registry 8 The Ombudsman shall act as the registrar. 9(1) The registrar shall establish and maintain a registry in which shall be kept all returns filed under this Act as re- vised by other documents submitted to the registrar under this Act. 9(2) The registry shall be organized in the manner and kept in the form that the registrar may determine. 9(3) The registry shall be available for public inspection in the manner and during the time that the registrar may determine. 10 The registrar may verify the information contained in any return or other document submitted to the registrar under this Act.

Commencement 11 This Act comes into force on a day to be fixed by proclamation.

Registraire et registre 8 L’Ombudsman remplit les fonctions de registraire. 9(1) Le registraire crée et tient un registre auquel sont versées toutes les déclarations déposées aux termes de la présente loi, telles qu’elles sont modifiées par les autres documents qui lui sont remis aux termes de la présente loi. 9(2) Le registre est tenu en la forme et selon les modali- tés que fixe le registraire. 9(3) Le registre est mis à la disposition du public aux fins de consultation de la manière et aux heures que fixe le registraire. 10 Le registraire peut vérifier les renseignements que contiennent les déclarations et les autres documents qui lui sont remis aux termes de la présente loi.

Entrée en vigueur 11 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur à la date fixées par proclamation.
