DESIGNATION AND TRANSFER OF

RESPONSIBILITY AMENDMENT REGULATION

on November 5, 2021 pursuant to sections 16, 17 and 18 of the Government

Organization Act.

1 The Designation and Transfer of Responsibility

Regulation (AR 44/2019) is amended by this Regulation.

Section 3 is amended

(

a) in subsections (1) and (2) by striking out "Minister of

Agriculture and Forestry" and substituting "Minister of

Agriculture, Forestry and Rural Economic Development";

(

b) by repealing subsection (2.1) and substituting the

following:

(2.1) The Minister of Agriculture, Forestry and Rural Economic

Development continues to be responsible for the Property Rights

Advocate Act.

(

c) in subsections (3) and (4) by striking out "Minister of

Agriculture and Forestry" and substituting "Minister of

Agriculture, Forestry and Rural Economic Development".

Section 10(3) is amended by striking out "Minister of

Agriculture and Forestry" and substituting "Minister of

Agriculture, Forestry and Rural Economic Development".

Section 20(2) is amended by striking out "Minister of

Agriculture and Forestry" and substituting "Minister of

Agriculture, Forestry and Rural Economic Development".

AND RURAL ECONOMIC DEVELOPMENT".

Section 1 is amended by striking out "Agriculture and

Forestry" and substituting "Agriculture, Forestry and Rural

Economic Development".

Section 5(2) is amended by striking out "or" at the end of

clause (b), by adding "or" at the end of clause (

adding the following after clause (c):

Real Estate Act

REAL ESTATE EXEMPTION

AMENDMENT REGULATION

section 84(1) of the Real Estate Act.

1 The Real Estate Exemption Regulation (AR 111/96) is

amended by this Regulation.

Section 1 is amended by adding the following after

clause (a):

(a.1) "Administrator" means a person appointed by the court as an

administrator under

section 58 of the Condominium Property

Act;

Section 2 is amended by adding the following after

subsection (3):

(4) Where all the condominium units of a condominium corporation

are owned by the same person, group of persons or entity, the

provision of condominium management services to that

condominium corporation is exempt from the provisions of the Act.

(5) Where the only condominium management service engaged in is

collecting, or offering or attempting to collect, on behalf of the

condominium corporation, money payable as

(

a) rent for the use of corporation-owned units or property, or

(

b) contributions levied by the condominium corporation or

other amounts levied by or due to the corporation under the

Condominium Property Act,

the provision of that condominium management service is exempt

from the provisions of the Act.

(6) An Administrator is exempt from the Act as it relates to the

provision of condominium management services.

Section 2.1 is repealed.

Section 3 is amended by striking out "June 30, 2023" and

substituting "June 30, 2028".

6 This Regulation comes into force on December 1, 2021.

Responsible Energy Development Act

RESPONSIBLE ENERGY DEVELOPMENT ACT

GENERAL AMENDMENT REGULATION

section 78 of the Responsible Energy

Development Act.

1 The Responsible Energy Development Act General

Regulation (AR 90/2013) is amended by this Regulation.

Section 1(2) is repealed and the following is substituted:

(2) For the purposes of

section 29 of the Act, "facility" means a

facility as defined in the Oil and Gas Conservation Act except that it

includes

(

a) a processing plant as defined in the Oil Sands Conservation

Act, and

(

b) a pipeline as defined in the Pipeline Act that is licensed by

the Regulator and over which the Regulator has jurisdiction.
