1 2005 BILL 32 Right to Read Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows:

Definitions 1 In this Act, “Committee” means the Committee established in

section 2; (Comité) “Minister” means the Minister of Education; (ministre) “objectives” means the objectives aimed at the enhancement of school libraries established in sec- tion 4; (objectifs) “term” means four years. (mandat) Establishment of Committee 2 A body for study and consultation is established under the name “Committee for Restoring School Libraries” in English and “le Comité pour l’amélio- ration des bibliothèques scolaires ” in French here- inafter called “the Committee”. Désigne les objectifs visés à l’amé- lioration des bibliothèques scolaires en application de l’article 4. (objectives) Création du Comité 2 Un organisme d’étude et de consultation appelé en français « le Comité pour l’amélioration des bi- bliothèques scolaires » et en anglais « Committee for Restoring School Libraries », appelé par la suite « le Comité » dans la présente loi.

Loi sur le droit de lire Duties of the Committee 3 The Committee shall (

a) provide advice and counsel to the Minister on achieving the objectives, and (

b) report to the Legislative Assembly on the progress made towards the objectives and the ad- ditional steps required to ensure their attainment. Objectives 4 The Minister shall consult with the Committee in order to further the attainment of the following objectives by December 31, 2009: (

a) equipping every school, as defined by the Education Act, with a school library which is an effective centre for the development of reading, research and problem-solving skills; (

b) maintaining data for each district regarding (

i) spending on library books and other me- dia; (ii) number of holdings provincially of li- brary books and other media; (iii) number of library books by Canadian authors; (iv) number of qualified librarians and teacher librarians in schools; and (

v) number of hours which school libraries are open, staffed, and available to students; (

c) implementing an increase in library books and other media holdings by fifty percent from the levels in place on January 1, 2005; Fonctions du Comité 3 Le Comité :

a) conseille et donne son avis au ministre sur l’atteinte des objectifs;

b) rend compte à l’Assemblée législative du progrès qu’il a fait face aux objectifs et aux dé- marches additionnelles requises pour assurer leur atteinte. Objectifs 4 Le ministre consulte le Comité afin de favoriser l’atteinte des objectifs suivants avant le 31 décem- bre 2009 :

a) équiper chaque école, telle que définie dans la

Loi sur l’éducation , d’une bibliothèque sco- laire qui est un centre propice au le développe- ment de la lecture, de la recherche et des habile- tés des résolutions des problèmes;

b) pour chaque district, garder les données por- tant sur : (

i) les dépenses des livres de bibliothèque et autres médias, (ii) le nombre de livres de bibliothèque et autres médias appartenant à la province, (iii) le nombre de livres de bibliothèque d’auteurs canadiens, (iv) le nombre de bibliothécaires qualifiés et d’enseignants-bibliothécaires dans les écoles, (

v) nombre d’heures d’ouverture de la bi- bliothèques, surveillées et disponibles aux étudiants;

c) réaliser une augmentation du nombre de li- vres et autres médias en bibliothèque au 1 er jan- vier 2005 de 50 %;

d) ensuring that school libraries increase the proportion of their holdings which are the copy- righted works of Canadian authors; (

e) creating a professional designation for the position of teacher-librarian and school librarian; (

f) ensuring that schools have access to librari- ans and teacher librarians who are available to teaching faculty to assist in the development of programs and pedagogy; (

g) ensuring that students at every school have adequate access to their library and librarians during instructional time, and for reasonable times outside normal hours of in-class instruc- tion; and (

h) developing provincial standards for the dedicated funding of the maintenance and en- hancement of school library collections. Committee Report 5(1) The Committee shall report to the Legislative Assembly each calendar year no later than the thirty-first day of December, by filing a report with the Speaker of the Legislative Assembly. 5(2) The report of the Committee shall contain (

a) a report on progress toward the objectives, (

b) information on the level of funding, by dis- trict, designated to school libraries, (

c) recommendations for making further progress on the objectives, including the ade- quacy of current levels of funding, and (

d) any further information the Committee shall see fit in its discretion.

f) s’assurer que les écoles ont accès aux biblio- thécaires et aux enseignants-bibliothécaires à la disponiblité du personnel enseignant pour les as- sister dans le développement des programmes et de la pédagogie;

g) s’assurer que les étudiants de chaque école ont un accès adéquat à leur bibliothèque et aux bibliothécaires pendant la période d’enseigne- ment, et pour des périodes raisonnables en de- hors des heures normales d’enseignement faite en classe;

h) développer des normes provinciales pour le financement consacré à l’entretien et l’améliora- tion des collections des bibliothèques scolaires. Rapport du Comité 5(1) Le Comité rendra compte à l’Assemblée lé- gislative au plus tard le 31 décembre de l’année ci- vile, en déposant un rapport au président de l’As- semblée législative. 5(2) Le rapport contient

a) un rapport sur le progrès des objectifs;

b) des données sur le niveau de financement, par le district scolaire, désigné aux bibliothèques scolaires;

c) des recommandations pour faire plus de pro- grès sur les objectifs, y compris la capacité du ni- veau de financement actuels;

d) toutes autres informations que le Comité, se- lon sa discrétion, considère appropriées.

Loi sur le droit de lire 5(3) The Minister may, by regulation, impose ad- ditional requirements upon the report of the Com- mittee. 5(4) The Minister shall, within ninety days of re- ceipt of the Committee’s report by the Office of the Speaker of the Legislative Assembly, lay before the Legislative Assembly a response to any recommen- dations for future steps made by the Committee.

Composition of Committee 6(1) The Committee shall consist of up to nine members appointed by the Minister. 6(2) The Minister shall appoint a Chairperson. 6(3) The Minister shall ensure that at least one member of the Committee is a school librarian em- ployed within the Province of New Brunswick. 6(4) The Minister shall ensure that at least three members of the Committee are school teachers em- ployed within the Province of New Brunswick. 6(5) The Minister shall ensure representation from the anglophone and francophone education systems when making appointments to the Commit- tee. 6(6) The Minister shall, in making appointments under subsection (4), consult with the associations representing teachers in negotiations under the Pub- lic Service Labour Relations Act.

Reappointment or replacement of members 7(1) The members of the Committee shall con- tinue to serve notwithstanding the expiry of their term until notice is given to the Minister. 7(2) The Minister shall fill any vacancy upon the Committee as required. 5(3) Le ministre peut, par règlement, imposer des exigences sur le rapport du Comité. 5(4) Le ministre peut, dans les 90 jours de la ré- ception du rapport du Comité par le Bureau du pré- sident de l’Assemblée législative, porter devant l’Assemblée législative une réponse à toute recom- mandation faites par le Comité pour prendre des dé- marches futures.

Composition du Comité 6(1) Le Comité se compose d’un maximum de neuf membres nommés par le ministre. 6(2) Le ministre nomme une personne à la prési- dence. 6(3) Le ministre s’assure qu’il y a au moins un membre du Comité qui est bibliothécaire employé au Nouveau-Brunswick. 6(4) Le ministre s’assure qu’au moins trois mem- bres du Comité est un enseignant employé au Nouveau-Brunswick. 6(5) Le ministre s’assure que les systèmes d’édu- cation francophones et anglophones sont représen- tés lorsqu’il fait les nominations du Comité. 6(6) Le ministre, en faisant des nominations en vertu du paragraphe (4), consulte les associations qui représentent les enseignants en négociations en vertu de la Loi relative aux relations de travail dans les services publics.

Renouvellement des nominations ou remplacement des membres 7(1) Les membres du Comité demeureront en fonction nonobstant l'expiration de leur mandat, jusqu'à ce que le ministre soit avisé. 7(2) Le ministre rempli tout poste vacant du Co- mité tel que requis.

5 Right to Read Act Bill 32 Compensation 8 The Minister may, by regulation, establish com- pensation to be paid to members of the Committee. Amendments 9 Subsection 57(1) of the Education Act,

chapter E-1.12 of the Acts of New Brunswick, 1997, is amended (

a) by adding after paragraph (

e) the follow- ing: (e.1) respecting the minimum levels of funding and hours of operation for school libraries; (

b) by adding after paragraph (w.1) the fol- lowing: (w.1.1) respecting the qualifications needed for the designation of teacher-librarian; Lapse 10 This Act shall lapse on December 31, 2009. Commencement 11 This Act comes into force upon proclamation. Rémunération 8 Le ministre peut, par règlement, établir une ré- munération à être payée aux membres du Comité. Modifications corrélatives 9 Le paragraphe 57(1) de la

Loi sur l’éducation,

chapitre E-1.12 des Lois du Nouveau-Brunswick de 1997, est modifié

a) par l’adjonction, après l’alinéa e), de ce qui suit : e.1) respecter le niveau minimum de finance- ment et d’heures d’opération pour les bibliothè- ques scolaires;

b) par l’adjonction, après l’alinéa w.1), de ce qui suit : w.1.1) respecter les qualifications necessaires pour les designations des enseignants- bibliothécaires; Expiration 10 La présente loi expire le 31 décembre 2009. Entrée en vigueur 11 La présente loi entre en vigueur par procla- mation.
