Smugglers Cove Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 82-973 (August 10, 1982), N.S. Reg. 179/82

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 9th day of July, A.D., 1982, and pursuant to

Section 2 of

Chapter 244 of the

Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to:

(

a) rescind Order in Council 75-163 dated the 11th day of February, A.D., 1975, a copy

of which is attached to the report and recommendation as

Schedule “A”;

(

b) constitute all that area of land situate at Smugglers Cove, in the County of Digby,

owned by Her Majesty in right of the Province of Nova Scotia, to be a Provincial

Park, the said area of land being described in

Schedule “C” and shown outlined in

red on the copy of Crown Land Records Plan No. E-13-32 marked

Schedule “D”,

both Schedules attached to and forming part of the report and recommendation; and

(

c) declare that the park shall be known by the name of “Smugglers Cove Provincial

Park”.

Schedule “C”

All that certain lot, piece or parcel of land situate, lying and being at Smugglers Cove, in the

County of Digby, Province of Nova Scotia as shown on Plan No. E-13-32 filed in the Crown

Land Records Office, Department of Lands and Forests, Halifax, the said land being more

particularly described as follows:

Beginning at a survey marker numbered D463 situate at the southerly extent of lands of

Richard J. Comeau and on the westerly boundary of Nova Scotia Highway No. 1, also being (by

grid bearings referenced to the Nova Scotia 3° Modified Transverse Mercator Projection, zone

5, central meridian 64° 30' west longitude) S 15° 43' 10" E, a distance of 375.55' from Nova

Scotia Coordinate Monument No. 26063 having coordinate values (Northing 16,054,755.23'

and Easting 17,603,632.18').

Thence (from the place of beginning) S 26° 59' 00" E following the western boundary of Nova

Scotia Highway No. 1, a distance of 67.86' to survey marker D462;

Thence S 38° 45' 50" W following a northwesterly boundary of lands of Ambroise Boles, a

distance of 192.08 to survey marker D397;

Thence S 11° 06' 30" W following a northwesterly boundary of lands formerly of Benoit

Robichaud, a distance of 204.07' to survey marker D398;

Thence N 52° 15' 00" W following a northeasterly boundary of lands formerly of Benoit

Robichaud, a distance of 539.59' to survey marker D399;

Thence N 33° 37' 50" W following a northeasterly boundary of lands of Desire Comeau, a

distance of 796.48' to survey marker D401;

Thence continuing N 33° 37' 50" W along the northeasterly boundary of lands of Desire

Comeau, 41' more or less to the ordinary high water mark of St. Marys Bay;

Thence in a generally northerly, southeasterly and easterly direction following the several

courses of the ordinary high water mark of St. Marys Bay and Comeau Cove, 1060' more or

less to the mouth of a small brook flowing into Comeau Cove;

Thence in a generally southeasterly and easterly direction following the several courses of the

ordinary high water mark of a small brook, 210' more or less to a point;

Thence S 43° 43' 50" E following the southwesterly boundary of lands of James T. Comeau,

80' more or less to survey marker D469;

Thence continuing S 43° 43' 50" E following the southwesterly boundary of lands of James T.

Comeau, a distance of 48.05' to survey marker D468 situate on the easterly boundary of Nova

Scotia Highway No. 1;

Thence S 01° 26' 50" E following the easterly boundary of Nova Scotia Highway No. 1, a

distance of 40.06' to survey marker D467;

Thence S 72° 17' 10" W following the northwesterly boundary of lands of Clare Chamber of

Commerce, a distance of 224.20' to survey marker D466;

Thence S 17° 47' 40" E following a southwesterly boundary of the aforementioned lands of

Clare Chamber of Commerce, a distance of 156.41' to survey marker D465;

Thence S 67° 17' 30" W following the northwesterly boundary of lands of George Saulnier and

Agnes Saulnier, a distance of 151.23' to survey marker D464;

Thence S 42° 19' 50" E following the southwesterly boundary of lands of George Saulnier and

Agnes Saulnier, lands of the Estate of Zacharie Saulnier, and lands of Richard J. Comeau, a

distance of 684.82 to the place of beginning.

Containing 16.2 acres more or less.
