OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated October 31, 2003, and pursuant to Sections 7 and 16 of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and

Section 19 of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act, is pleased to: (

a) approve the issuance, by the Minister of Natural Resources, to Nova Scotia Power Incorporated, a body corporate with a registered office at Halifax, Halifax County, its successors and assigns, of: (

i) grants and deeds for the conveyance of Crown lands situate at Wreck Cove, Victoria County, containing an area of approximately 700 hectares, shown outlined in red and shaded grey, green, purple or brown and referred to as Lots T1, T1A, T1-B, T1-C, T1-D, T2, D1, D2, D3, D4, D5, D7, D8-1, D8-2, D8-3, D9-D10, D10-A, D10-B, D11, C1, C2, C3 and C5 on

Schedule "A" attached to and forming part of the report and recommendation; (ii) easements for the purpose of providing access and for constructing, maintaining and using roads with respect to Crown lands being approximately 20 metres wide, near Wreck Cove, Victoria County, and in Inverness County, at the locations shown in red dashed lines and highlighted yellow, and as otherwise indicated, on

Schedule "A" attached to and forming part of the report and recommendation; (iii) easements for the purpose of installing, maintaining and using transmission lines for the transmission of electricity and communications signals only with respect to Crown lands being approximately 10 metres wide, near Wreck Cove, Victoria County, at the locations shown in green dashed lines on

Schedule "A" attached to and forming part of the report and recommendation; (iv) easements for the purpose of installing, maintaining and using transmission lines for the transmission of electricity and communications signals only with respect to Crown lands being approximately 30 metres wide, near Wreck Cove, Victoria County, at the locations shown in double red dashed lines on

Schedule "A" attached to and forming part of the report and recommendation; (

v) easements for the purpose of installing, maintaining and using culverts only with respect to Crown lands being near Wreck Cove, Victoria County, at the locations shown hatched and highlighted yellow on

Schedule "A" attached to and forming part of the report and recommendation; and (vi) easements for the purpose of hydro flowage, including the right to install, access and maintain underwater infrastructure, with respect to Crown lands flooded at each full supply level and up to the 100 year flood elevation and emergency flowage elevation near Wreck Cove, Victoria County, and shown as Cheticamp Flowage, Ingonish No. 1, Ingonish No. 2, Gisborne Flowage, Wreck Cove Flowage, McMillan Flowage, and South Lake Flowage on

Schedule "B" attached to and forming part of the report and recommendation; all for the consideration of $120,000; (

b) approve the issuance of a lease of Crown lands situate near Wreck Cove, Victoria County, containing an area of approximately 3.5 hectares, shown in orange and referred to as Parcel GP-3 on

Schedule "A" attached to and forming part of the report and recommendation for the purpose of developing, maintaining and operating a rock and gravel pit and extracting and removing materials therefrom, to Nova Scotia Power Incorporated, a body corporate with a registered office at Halifax, Halifax County, its successors and assigns by the Minister of Natural Resources for a term of 10 years at an annual rent of $300, with the right to renew the lease for a further 10 year term at a rent to be determined by the Lessor, provided that the Lessee has satisfactorily complied with the terms and conditions of the lease; (

c) approve the acquisition, for the nominal consideration of $1.00, of a right of way at the location shown as "66 Foot Wide Right Of Way to DNR" on

Schedule "A" attached to and forming part of the report and recommendation, by the Minister of Natural Resources, from Nova Scotia Power Incorporated, a body corporate with a registered office at Halifax, Halifax County, its successors and assigns; (

d) rescind Orders in Council 92-782, 92-783 and 92-784, all made August 6, 1992; and (

e) authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
