Order in Council 631/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas in the 1980’s the Government of Ontario (the “Government”) approved the transfer of the lands and premises described in

Schedule “A” attached hereto that were the site of the Staff Development Centre located in the Town of Innisfil and operated by the Civil Service Commission, now known as the Kempenfelt Conference Centre, (the “Lands”), to the Georgian College of Applied Arts and Technology (“Georgian College”) for its use and operation;

Whereas the Lands were transferred to Georgian College on condition that should the Lands no longer be operated as an adult learning facility that the Government may request the return of the Lands;

Whereas pursuant to the Ontario Colleges of Applied Arts and Technology Act, 2002 , Georgian College is an agent of the Government and the Lands are, therefore, property of Her Majesty the Queen in Right of Ontario.

Whereas pursuant to the Ministry of Infrastructure Act, 2011, the Minister of Infrastructure is responsible for certain real property or interests in real property held for the use or purposes of the Government;

Whereas the Ontario Infrastructure and Lands Corporation (“ OILC ”) has been delegated certain of the Minister of Infrastructure’s authorities with respect to real property or interests in real property;

Whereas the Kempenfelt Conference Centre was closed by Georgian College effective October 31, 2017 and the Lands are no longer required by Georgian College for use as an adult learning facility;

And

Whereas the Ministry of Infrastructure has identified that the Lands are required for the use or purposes of the Government and advised Georgian College that it will be seeking an Order in Council to transfer administration and control of the Lands to the Minister of Infrastructure:

Now therefore , pursuant to the Royal Prerogative, the administration and control of the Lands are transferred from Georgian College to the Minister of Infrastructure and the Minister and OILC are authorized to execute such documents as may be necessary in respect of the transfer.
