An Act to Amend the Human Rights Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 The Human Rights Act,

chapter H-11 of the Revised Statutes, 1973, is amended by adding after subsection 5(3) the following: 5.1(1) No contract of automobile, life, accident, sickness or disability insurance shall differentiate, make a distinction, exclusion, preference or dis- criminate against any person because of age or geo- graphic region. 5.1(2) Notwithstanding subsection (1), a limita- tion, specification, exclusion, denial or preference because of age or geographic region shall be permit- ted if such limitation, specification, exclusion, de- nial or preference is based upon a bona fide and rea- sonable ground as determined by the Commission. chapitre H-11 des Lois révisées de 1973, est modifié par l’adjonction après le paragraphe 5(3) de ce qui suit: 5.1(1) Un contrat d’assurance automobile, vie, ac- cident, maladie ou incapacité ne doit pas différen- cier, faire de distinction, exclure ou faire des préfé- rences pour des raisons d’âge ou de région géographique. 5.1(2) Nonobstant le paragraphe (1), une restric- tion, condition, exclusion ou préférence ou un refus fondé sur l’âge ou la région géographique est auto- risé si cette restriction, condition, exclusion ou pré- férence ou un refus est fondé sur une qualification réellement requise et raisonnable selon ce que déter- mine la Commission.
