chapter R-10.2 of the Acts of New Brunswick, 1975, is amended in sec- tion 11.1 by adding after subsection (2) the following: 1 L’article 11.1 de la

chapitre R-10.2 des Lois du Nouveau- Brunswick de 1975, est modifié par l’adjonction de ce qui suit après le paragraphe (2) : 11.1(2.01) Despite subsections (1) and (2), a landlord shall not increase the rent to a tenant for the twelve- month period following the commencement of a week to week, month to month, year to year or fixed term ten- ancy. 11.1(2.01)

Malgré ce que prévoient les paragraphes (1) et (2), le propriétaire ne peut augmenter le loyer du loca- taire au cours des douze mois qui suivent le début d’une location à la semaine, au mois, à l’année ou pour une pé- riode déterminée. 11.1(2.02) Despite any other provision of this Act, in no case shall a landlord increase the rent to the tenant more than once in a twelve-month period. 11.1(2.02)

section 11.1 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 11.1 : Allowable rate of rent increase Taux admissible d’augmentation du loyer 11.11(1) In this section, “allowable rate” means the rate prescribed by regulation. 11.11(1) Dans le présent article, « taux admissible » désigne le taux prescrit par règlement. 11.11(2) No landlord shall increase the rent charged to a tenant between January and December of any year by more than the allowable rate. 11.11(2) Le propriétaire ne peut augmenter au-delà du taux admissible le loyer du locataire entre le er janvier et le décembre de chaque année. 1 11.11(3) The Minister of Finance and Treasury Board shall have the allowable rate for each calendar year pub- lished in The Royal Gazette not later than August of the preceding year. 11.11(3) Le ministre des Finances et du Conseil du Trésor fait publier dans la Gazette royale , au plus tard le août de l’année précédente, le taux admissible pour chaque année civile. 11.11(4) A landlord may apply to the Chief Residen- tial Tenancies Officer for an order permitting the rent charged to a tenant to be increased by more than the al- lowable rate if the landlord incurs: 11.11(4) Le propriétaire peut demander au médiateur en chef des loyers d’autoriser une augmentation de loyer supérieure au taux admissible, si, selon le cas : (

a) an extraordinary increase, as prescribed by regu- lation, in the cost of municipal taxes and charges for the premises or the building in which the premises are located; or

b) an eligible capital expenditure, as prescribed by regulation, respecting the premises or the building in which the premises are located.

a) in paragraph (g.5) by striking out “and” at the end of the paragraph;

b) by adding after paragraph (g.5) the following:
