definitions apply in this section. 6.1(1) Les définitions qui suivent s’appliquent au pré- sent article. “employer” means employer as defined in the Public Service Labour Relations Act. (employeur) “enactment” includes a regulation, order or other in- strument made under the authority of

an Act. (texte lég- islatif) “public service” has the same meaning given to the expression “Public Service” in the Public Service La- bour Relations Act, and includes any portion of the pub- lic service of the Province designated by the Lieutenant- Governor in Council as part of the public service for the purpose of this section. (services publics) “special payment” or “special benefit” means any payment or benefit but does not include any payment in lieu of notice of termination in an amount consistent with common law principles or any payment or benefit « employeur »

S’entend selon la définition que donne de ce terme la Loi relative aux relations de travail dans les services publics. (employer) « paiement spécial » ou « prestation spéciale » Tout paiement ou toute prestation, à l’exclusion d’une indem- nité tenant lieu de préavis de cessation dont le montant s’avère conforme aux principes de common law ainsi que de tout paiement ou de toute prestation versés en vertu :

a) d’un texte législatif;

b) d’un régime de pension qui est agréé conformé- ment à la Loi de l’impôt sur le revenu (Canada); 1 (

a) provided under an enactment, (

b) provided under a pension plan registered under the Income Tax Act (Canada), (

c) provided under a retirement compensation ar- rangement as defined in the Income Tax Act (Canada), or (

d) provided under an employment contract, exclud- ing any term that provides for payment of an amount in lieu of notice of termination that is greater than an amount consistent with common law principles and that was agreed to during the period referred to in subsection (3). (paiement spécial) or ( prestation spé- ciale)

(special payment) ou (special benefit) « services publics » S’entend au sens que lui confère la Loi relative aux relations de travail dans les services publics et s’entend également de tout élément des ser- vices publics de la province que désigne le lieutenant- gouverneur en conseil comme faisant

partie des services publics aux fins d’application du présent article. (public service) « texte législatif »

(enactment) 6.1(2) Despite sections and 6, if the employment contract of any person employed in the public service is terminated after the commencement of this section, nei- ther the Province nor an employer shall provide a special payment or special benefit to the person as a result of the termination nor agree with the person to do so nor en- gage in negotiations with the person to that end. 6.1(2) Par dérogation aux articles et 6, si le contrat de travail d’une personne employée dans les services pu- blics est résilié après la date d’entrée en vigueur du pré- sent article, ni la province ni l’employeur ne peuvent ni lui verser ou se mettre d’accord avec elle pour lui verser un paiement spécial ou une prestation spéciale par suite de cette résiliation, ni entreprendre avec elle des négo- ciations à cette fin. 6.1(3) Subsection (2) applies only between the period beginning on the date the writs are issued for a provin- cial general election and ending on the date of the post- election appointment of the new members of the Execu- tive Council. 6.1(3) Le paragraphe (2) ne s’applique que pendant la période qui commence à la date d’émission des brefs d’élections générales provinciales et qui prend fin à la date de la nomination post-électorale des nouveaux membres du Conseil exécutif. 6.1(4) This

section does not apply to a person em- ployed in the public service who is represented by a bar- gaining agent as defined in the Public Service Labour Relations Act. 6.1(4) Le présent
