The Lieutenant Governor in Council

(

a) dissolves The Village of Cluny and transfers its area to The County of Wheatland No. 16, and

(

b) makes the order in the Schedule,

effective September 15, 1995.

SCHEDULE

1. Any taxes owing to The Village of Cluny at its dissolution, including any lawful penalties and costs levied in respect of such taxes, are transferred to and become payable to The County of Wheatland No. 16 and may be collected and dealt with by The County of Wheatland No. 16 as if it had imposed the taxes.

2. The assessor for The County of Wheatland No. 16, shall for purposes of the 1996 taxation year, assess the land that was located in The Village of Cluny at its dissolution and the assessable improvements to the land and the assessments shall be fair and equitable with other land and assessable improvements in The County of Wheatland No. 16.

3. All assets, liabilities, whether arising under a debenture or otherwise, rights, duties, functions and obligations of The Village of Cluny are vested in The County of Wheatland No. 16 and may be dealt with in its name.

4. The employees of The Village of Cluny at its dissolution are employees of The County of Wheatland No. 16.

5. A reference to The Village of Cluny in any order, regulation, bylaw, certificate of title, agreement or any other instrument is deemed to be a reference to The County of Wheatland No. 16.

6. The area of The Village of Cluny at its dissolution is included in the ward of The County of Wheatland No. 16 called "Division 1".

7(1) The County of Wheatland No. 16 shall use the money received from The Village of Cluny at its dissolution, together with the money received from the sale of any of the assets of the Village, to pay the liabilities transferred to the County from the Village at its dissolution.

(2) The County of Wheatland No. 16 shall take the money referred to in subsection (1) after the liabilities are paid and deposit it in a capital reserve trust fund established by the County.

(3) The funds in the capital reserve trust fund may only be used for projects within the area that was located within The Village of Cluny at its dissolution.

Medalta Potteries, one of the oldest and most successful ceramics plants in Western Canada, began as a manufacturer of stoneware in 1913 and soon became a major producer of stoneware in Canada. In the 1940s, Medalta became dominant in the manufacturing of semi-porcelain hotel ware. The Medalta Potteries Plant is one of the oldest extant ceramics plants in Canada.

It is therefore considered that preservation and protection of the resource is in the public interest.
