EXPLANATORY NOTE NOTE EXPLICATIVE This Bill amends The Non-Smokers Health Protection Act by prohibiting the sale or supply of flavoured toba cco products. Menthol tobacco products, snuff and chewi ng tobacco are exempt from this prohibition. Le présent projet de loi a pour objet de modifier l a

Cette interdiction ne s'appliquerait toutefois pas aux produits du tabac au menthol, au tabac sans fum ée et au tabac à mâcher. The Bill also extends the general prohibition again st selling or supplying tobacco products to children b y repealing the exemption allowing a parent to provid e tobacco to his or her child in a non-public place.

L'exception autorisant les parents à fournir des produits du tabac à leurs enfants ailleurs que dans un lieu pub lic serait abolie et il serait désormais complètement interdit de vendre ou de fournir de tels produits aux mineurs.

definitions: "flavoured tobacco product" means a tobacco product (

a) that has an aroma or taste other than tobacco that is apparent either before or during use, or both, and includes a tobacco product that has an aroma or taste resulting from one or more additives, including but not limited to, candy, chocolate, fruit, spice, herb, alcohol or vanilla additives, 2(1) Le paragraphe 1(1) est modifié par adjonction des définitions suivantes : « produit du tabac » Tabac, sous toutes les formes permettant son utilisation ou sa consommation, notamment les cigarettes, les cigares, le tabac san s fumée, le tabac à mâcher, le tabac naturel en feuilles, les produits du tabac aromatisé et les produits du tabac au menthol. b) that is, by its packaging, labelling, advertising or otherwise, represented as being flavoured, or (

c) that is designated in the regulations as a flavoured tobacco product, but does not include snuff, chewing tobacco or a menthol tobacco product; (« produit du tabac aromatisé ») "menthol tobacco product" means (

a) a tobacco product (

i) that, in addition to any aroma or taste resulting from tobacco, has a menthol aroma or taste resulting from a menthol additive, (ii) that has no other non-tobacco aroma or taste — apparent either before or during use, or both — except menthol, and (iii) that is represented by its packaging or labelling as being menthol-flavoured, with no other non-tobacco flavour, aroma or taste being represented in its packaging, labelling, advertising or otherwise, or (

b) a tobacco product that is designated in the regulations as a menthol tobacco product, but does not include a tobacco product excluded from this definition by regulation; (« produit du tabac au menthol ») "tobacco product" means tobacco in any form in which it is used or consumed, including cigarettes, cigars, snuff, chewing tobacco and raw leaf tobacco, and, for greater certainty, includes a flavoured tobacco product and a menthol tobacco product; (« produit du tabac ») « produit du tabac aromatisé » Produit du tabac présentant l'une ou l'autre des caractéristiques suivantes :

i) outre l'arôme ou le goût attribuables au tabac, il a un arôme ou un goût de menthol en raison de la présence d'additifs à base de menthol, (ii) outre le menthol, il n'a avant ou pendant sa consommation, ou au cours de ces deux étapes, aucun arôme ou goût non liés à la présence de tabac, (iii) il est présenté comme étant aromatisé exclusivement au menthol notamment de par son emballage, son étiquetage ou la publicité s'y rapportant;

b) il est désigné par règlement à

titre de produit du tabac au menthol. La présente définition ne vise pas les produits du tabac qui sont exclus par règlement. Inference as conclusive evidence 6.5(3) In a prosecution or proceeding for a contravention of subsection (1), where a container o r package gives rise to a reasonable inference that th e contents of the container or package are a flavoured tobacco product, in the absence of evidence to the contrary, the contents shall be conclusively deemed to be a flavoured tobacco product.
