B.C. Reg. 11/2018 , deposited February 7, 2018, under the MOTOR VEHICLE ACT [section 210 (2) (

q) and (9)]. Order in Council 34/2018, approved and ordered February 7, 2018.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that the Motor Vehicle Act

Regulations, B.C. Reg. 26/58, are amended as set out in the attached Schedule.

Schedule

Section 1 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended by adding the following definition:

“ CMVSS” means the Canada Motor Vehicle Safety Standards, under the Motor Vehicle Safety Act (Canada), as those standards amended from time to time; .

Section 11.01 (1) is amended

(

a) by adding the following definition:

“multifunction school activity bus” has the same meaning as in the Motor Vehicle Safety Regulations (Canada); , and

(

b) by repealing the definition of “yellow and black school bus” and substituting the following:

“yellow and black school bus” means a bus that, on the date of its manufacture, conformed to the safety standards

under the Motor Vehicle Safety Act (Canada), and the Canadian Standards Association numbered CSA Standard D250, “School

Buses”, that were applicable to school buses on that date, but does not include a multifunction school activity bus.

Section 11.02 (2) is repealed and the following substituted:

(2) No person shall drive or operate, or allow or cause to be driven or operated, on a highway a vehicle as a school bus if any of the following apply:

(

a) the vehicle is a transit bus;

(

b) the vehicle is equipped with side-facing seats;

(

c) the vehicle does not conform to one or both of the following standards:

(

i) CMVSS 216;

(ii) CMVSS

Section 36.01 is amended by repealing the definition of “CMVSS” .
