Section 1 of the Tobacco Sales Act,

chapter T-6.1 of the Acts of New Brunswick, 1993, is amended by adding the following

definitions in alphabetical order: 1 L’article 1 de la

Loi sur les ventes de tabac, chapi- tre T-6.1 des Lois du Nouveau-Brunswick de 1993, est modifié par l’adjonction des définitions suivantes selon leur ordre alphabétique : “cigarillo” includes a tobacco product that (

a) is sold as a cigarillo, (

b) is in the form of a roll or tube, has a wrapper that contains natural or constituted leaf tobacco and (

i) weighs less than 1.4 grams or such other weight as may be prescribed by regulation, or (ii) has a cellulose, acetate or other type of filter, or (

c) is prescribed by regulation to be a cigarillo; “flavoured cigarillo” includes a cigarillo that is repre- sented as being flavoured, that contains a flavouring agent or that is presented by its packaging, by advertisement or otherwise as being flavoured; “flavoured tobacco product” includes a tobacco product that is represented as being flavoured, that contains a fla- vouring agent or that is presented by its packaging, by ad- « cigarillo » comprend tout produit du tabac qui remplit l’une des conditions suivantes :

Section 4 of the Act is amended 2 L’article 4 de la Loi est modifié (

a) by renumbering the

section as subsection 4(1);

b) by adding after subsection (1) the following:

b) par l’adjonction de ce qui suit après le paragra- phe (1) : 4(2) Notwithstanding subsection (1), no person shall sell or offer for sale any cigarillos unless the cigarillos are en- closed in a package that contains a minimum of 20 ciga- rillos. 4(2)

section 4 the fol- lowing: 3 La Loi est modifiée par l’adjonction de ce qui suit après l’article 4 : 4.1(1) No person shall sell or offer for sale a flavoured cigarillo unless the flavoured cigarillo has been prescribed by regulation. 4.1(1) Il est interdit de vendre ou d’offrir en vente des cigarillos aromatisés, sauf s’ils ont été prescrits par règle- ment. 4.1(2) No person shall sell or offer for sale a flavoured tobacco product unless the flavoured tobacco product has been prescribed by regulation. 4.1(2) Il est interdit de vendre ou d’offrir en vente des produits du tabac aromatisés, sauf s’ils ont été prescrits par règlement. 4

Section 12 of the Act is amended by adding after paragraph (

b) the following: 4 L’article 12 de la Loi est modifié par l’adjonction de ce qui suit après l’alinéa b) : (b.1) prescribing a maximum weight for the purpose of subparagraph (b)(

i) of the definition “cigarillo”; b.1) prescrivant un poids maximal aux fins d’appli- cation du sous-alinéa b)(

definitions “flavoured cigarillo” and “flavoured to- bacco product”; b.3) définissant « agent aromatisant » aux fins d’ap- plication des définitions de « cigarillo aromatisé » et de « produit du tabac aromatisé »; (b.4) prescribing permitted flavoured cigarillos for the purpose of subsection 4.1(1); b.4) prescrivant les cigarillos aromatisés autorisés aux fins d’application du paragraphe 4.1(1); (b.5) prescribing permitted flavoured tobacco prod- ucts for the purpose of subsection 4.1(2); b.5) prescrivant les produits du tabac aromatisés au- torisés aux fins d’application du paragraphe 4.1(2); 5
