B.C. Reg. 147/2008 , deposited June 6, 2008, pursuant to the SCHOOL ACT [Sections 78 and 175]. Order in Council 380/2008, approved and ordered June 6, 2008.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

(

a) the Francophone Education Authorities Regulation, B.C. Reg. 212/99, is amended as set out in

Schedule 1, and

(

b) the School Calendar Regulation, B.C. Reg. 114/2002, is amended as set out in

Schedule 2.

Schedule 1

Francophone Education Authorities Regulation

Section 3 of the Francophone Education Authorities Regulation, B.C. Reg. 212/99, is amended by striking out "the Municipal Act " wherever it appears and substituting "the Local Government Act ".

Section 11 is amended

(

a) by adding the following subsection:

(1.1) Subject to

section 12 (2), voting in an election may be by paper or electronic ballot. , and

(

b) by striking out

section 11 (3) and substituting the following:

(3) A member who has voted must, in accordance with the instructions, submit the ballot referred to in

section 10 (1) (

a) and complete, sign and submit the declaration referred to in

section 10 (1) (b),

(

a) if the member votes by paper ballot, at least 15 days before election day, or

(

b) if the member votes by electronic ballot, no later than 8 p.m. on election day.

3 The following

section is added:

Time for voting extended

11.1 If voting is delayed and the secr taire tr sorier considers that a significant number of members would not be able to vote without an extension under this section, the secr taire tr sorier may extend the time for the close of voting but the extension must not permit voting for a longer period of time than would have been permitted had voting not been delayed.

Section 1 of

Schedule D is amended

(

a) in paragraph (

o) by striking out "M125/90" and substituting "M236/2007", and

(

b) by repealing paragraphs (

p) and (q).

Section 2 of

Schedule D is amended by repealing paragraph (c).

Schedule 2

School Calendar Regulation

1 The School Calendar Regulation, B.C. Reg. 114/2002, is amended in

Schedule 1 (Supplement) in the Column for 2009/2010

(

a) opposite "Days in Session" by striking out "191" and substituting "192", and

(

b) opposite "Minimum number of days of instruction" by striking out "184" and substituting "185".
