Statute: Public Service Act Finance Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Finance dated, August 16, 2011, and pursuant to

Section 6 of

Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, subsections 72(1), 73(1) and

Section 77 of

Chapter 2 of the Acts of 2010, the Finance Act, is pleased to:

a) approve the Nova Scotia Strategic Opportunities Fund Incorporated entering into the new Fund Agreement and the new Commission Agreement substantially in the forms set forth in Schedules "A" and "B" attached to and forming part of the Report and Recommendation;

b) approve the Province providing the new Guarantee in favour of the immigrant investors substantially in the form set forth in

Schedule "C" attached to and forming part of the Report and Recommendation;

c) authorize officers of the Nova Scotia Strategic Opportunities Fund Incorporated, as authorized by its Board of Directors, to execute on behalf of the Corporation, the Fund Agreement, the Commission Agreement, any and all required promissory notes, and such other documents as may be necessary to permit the Corporation to continue its participation in the federal immigrant investor program; and

d) authorize the Minister of Finance to execute, on behalf of the Province, the Guarantee and such other documents as may be necessary to permit the Province to continue its participation in the federal immigrant investor program.
