OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice dated August 4, 1999, pursuant to Sections 6 and 7 of
Chapter 11 of the Acts of 1992, the Utility and Review Board Act, is pleased to: (
a) effective July 1, 1998, accept the resignation and revoke the appointment and designation of M. Heather Robertson of Halifax, Halifax Regional Municipality, as a full-time member and Chair of the Nova Scotia Utility and Review Board, which appointment and designation was made by Order in Council 96-73 dated January 31, 1996; (
b) determine that M. Heather Robertson of Halifax, Halifax Regional Municipality, shall, in respect of any application, appeal proceeding, matter or thing heard before her or commenced by her as a member, have and exercise the jurisdiction of a member, including the power to complete any unfinished matter and give a decision therein as if she had not retired, during the period commencing July 1, 1998, and ending at such time that she has completed any unfinished matters and given decisions therein; (
c) effective August 1, 1999, revoke the designation of John A. Morash of Halifax, Halifax Regional Municipality, as Vice-Chair of the Nova Scotia Utility and Review Board, which designation was made by Order in Council 96-464 dated June 25, 1996; (
d) effective August 1, 1999, designate John A. Morash of Halifax, Halifax Regional Municipality, to be Chair of the Nova Scotia Utility and Review Board; (
e) effective August 1, 1999, designate Margaret A.M. Shears of Halifax, Halifax Regional Municipality, to be Vice-Chair of the Nova Scotia Utility and Review Board; and (
f) order that the Province shall defend, negotiate or settle claims or charges made against John A. Morash, Chair, and Margaret A.M. Shears, Vice-Chair of the Nova Scotia Utility and Review Board and indemnify them from personal liability, provided however, that any claim arising out of their activities in relation to their appointment and designation is not based on fraud or criminal activity, and where the Province so defends them, the Province will be in control of the case.
