OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated April 14, 1999, pursuant to clauses 16(1)(
a) and (1)(
b) of
Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the granting of option agreements and easements over Crown lands, including watercourse lands, along the route shown on the plan marked
Schedule "A" attached to and forming part of the report and recommendation and to approve the conveyance by grant, deed, lease or easement of Crown lands for valve sites along the easement lands, along with associated rights of way to the valve sites, to each of Maritimes and Northeast Pipeline Limited Partnership, by its General Partner, Maritimes Northeast Pipeline Management Ltd., and Sable Offshore Energy Inc. for the purpose of installing, maintaining and using either or both a natural gas and natural gas liquids pipeline, upon the following terms: (
a) easements will be a combined total of 50 metres + wide with additional push out areas as approved by the Department of Natural Resources; (
b) valve sites will be situated as approved by the Department of Natural Resources and will be 1 acre+ in size; (
c) rights of way to the valve sites will be provided where no other reasonable access is available; (
d) the fee for each of the easements will be $350 per watercourse crossing and $400 per acre for all other Crown land, the exact acreage to be confirmed by survey; (
e) the fee for each valve site will be $800 per acre; (
f) payment of damages, administrative fees and reimbursement of costs as agreed to by the Department of Natural Resources; (
g) reversion to the Crown of all valve site lands and associated rights of way and surrender of the easements at the option of the Crown in the event that the pipelines are abandoned in accordance with the applicable provisions of the National Energy Board Act and the Pipeline Act, as the case may be; and (
h) compliance with the laws of the Province of Nova Scotia, and without limiting the generality of the foregoing, in particular the requirements of the Department of the Environment and the Department of Labour; and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
