An Act to Amend the Custody and Detention of Young Persons Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Custody and Detention of Y oung Persons Act,

chapter C-40 of the Acts of New Bruns- wick, 1985, is amended by adding after subsection (3) the following: 3(4) Notwithstanding anything in this Act, the Lieutenant-Governor in Council shall not designate any facility as a place of open custody, secure custody or tem- porary detention for young persons if the same facility houses offenders that are eighteen years of age or more. chapitre C-40 des Lois du Nouveau- Brunswick de 1985, est modifié par l’adjonction après le paragraphe (3) de ce qui suit : 3(4) Nonobstant toute disposition dans la présente loi, le lieutenant-gouverneur en conseil ne désignera pas un éta- blissement en tant qu’endroit de garde en milieu ouvert, en milieu fermé ou de détention temporaire des adoles- cents si ce même établissement garde également des con- trevenants âgés de dix-huit ans ou plus.
