Marketing of Agricultural Products Act
ALBERTA PULSE GROWERS MARKETING
AMENDMENT REGULATION

section 26 of the Marketing of
Agricultural Products Act and
section 9 of the Alberta Pulse Growers Marketing Plan
Regulation (AR 120/1999).
1 The Alberta Pulse Growers Marketing Regulation
(AR 129/99) is amended by this Regulation.
Section 5 is repealed and the following is substituted:
Refund of service charges
5(1) A service charge that is paid by or on behalf of a producer is
refundable to the producer on request of the producer in accordance
with this section.
(2) A request for a refund of the service charge must
(
a) be made in writing on a form that is established by the
Commission, and
(
b) contain the following information:
(
i) the producer's name;
(ii) the producer's mailing address, telephone number,
email address, if available, and producer identification
number, if available;
(iii) if the service charge was collected by a dealer, a copy of
the original cash ticket showing the deduction of the
service charge;
(iv) if the service charge was collected directly from the
producer, documentation stating the quantity of product
sold, the total sale price and the amount of the service
charge paid by the producer;
(
v) the legal description of the land where the pulse crop
was grown;
(vi) any other information in respect of the refund that is
requested by the Commission.
(3) A request for a refund must be received by the Commission at its
office
(
a) prior to the end of August, for a service charge collected
during the period commencing on the previous February 1
and ending on July 31, and
(
b) prior to the end of February, for a service charge collected
during the period commencing on the previous August 1 and
ending on January 31.
(4) Subject to subsection (5), a request for a refund that does not
comply with subsections (2) and (3) must not be considered by the
Commission and the producer is not entitled to a refund in respect of
the service charge in question.
(5) The Commission may consider a request for a refund that does
not comply with subsection (2) or (3) if the Commission is satisfied
that extenuating circumstances exist that warrant it doing so and may
(
a) refund the service charge in question, or
(
b) refuse to refund the service charge in question.
(6) The Commission must refund the service charge to the producer
(
a) within 90 days after the end of August, if the request
complies with subsection (2) and was received in accordance
with subsection (3)(a),
(
b) within 90 days after the end of February, if the request
complies with subsection (2) and was received in accordance
with subsection (3)(b), or
(
c) within 90 days after receipt of the request, if the request was
considered, and the service charge is to be refunded, under
subsection (5).
Section 22 is amended by striking out "June 30, 2024" and
substituting "June 30, 2031".
Alberta Regulation 49/2024
Marketing of Agricultural Products Act
ALBERTA MILK MARKETING AMENDMENT REGULATION

to sections 26 and 27 of the Marketing of Agricultural Products Act and
section 9 of
the Alberta Milk Plan Regulation (AR 28/2022).
1 The Alberta Milk Marketing Regulation (AR 151/2002) is
amended by this Regulation.
Section 8(5) is repealed and the following is substituted:
(5) Alberta Milk must pay at least 50% of any fee for any
reconciliation or verification audit under subsection (4) and may
allocate the remaining portion of the fee between Alberta Milk and
the processor.
Section 16 is repealed and the following is substituted:
Quota adherence
16(1) A licensed producer must deliver the producer's continuous
daily quota in accordance with the directives and administrative
orders of Alberta Milk.
(2) If a licensed producer delivers milk in excess of the producer's
continuous daily quota, Alberta Milk may charge the producer a levy
for the excess milk in accordance with the directives and
administrative orders of Alberta Milk.
(3) Alberta Milk may deduct any levy charged under subsection
(2) from payments owing to the licensed producer.

Land Titles Act
TARIFF OF FEES AMENDMENT REGULATION

1 The Tariff of Fees Regulation (AR 120/2000) is amended
by this Regulation.
2 The following is added after
section 1:
Individuals 65 years or older - total fee reduction
1.1(1) In this section,
(a) "registry agent" means a registry agent as defined in
section
1 of
Schedule 12 to the Government Organization Act;
(b) "registry service" means any service included in the
definition of "registry services" as set out in
section 1 of
Schedule 12 to the Government Organization Act;
(c) "service charge" means the amount charged by a registry
agent in accordance with the Registry Service Charges
Regulation (AR 183/2005);
(d) "total fee" means the sum of the fees prescribed under
section 1(1) for a registry service listed in the
Schedule and
the service charge for the registry service.
(2) Notwithstanding
section 1(1), and subject to subsection (3), an
individual shall receive a 25% reduction from the total fee for the
provision of a registry service listed in the
Schedule if the individual
provides proof, satisfactory to the Registrar, that, at the time a
request is submitted for the provision of the registry service, the
individual
(
a) is 65 years or older, and
(
b) is a resident of Alberta.
(3) A request under subsection (2) must be made
(
a) by the individual on the individual's own behalf, and
(
b) using a registry agent or the Government of Alberta's online
system.
(4) The 25% reduction from the total fee will first be applied to the
fees prescribed under
section 1(1).
(5) In the event the fees prescribed under
section 1(1) are less than
the 25% reduction applied in subsection (4),
(
a) the service charge must be reduced by the amount necessary
to provide a 25% reduction from the total fee, and
(
b) the Registrar shall reimburse the registry agent for the
reduction applied to the service charge.
3 The following is added after
section 18:

Council of proposing degree programs that meet those
standards and conditions;

b) the applicant institution has quality assurance policies
and procedures satisfactory to the Council.

c) in subsection (2) by striking out "the conditions and
standards referred to in subsection (1)" and substituting
"the standards and conditions established under
section 7";
(
d) in subsection (3) by striking out "the conditions or
standards referred to in subsection (1)" and substituting
"the standards or conditions established under
section 7".

REGISTRY SERVICE CHARGES
AMENDMENT REGULATION

1 The Registry Service Charges Regulation (AR 183/2005)
is amended by this Regulation.
2 Sections 1 and 2 are repealed and the following is
substituted:
Definitions
1 In this Regulation,
(a) "Act" means the Government Organization Act;
(b) "agreement" means an agreement made between a registry
agent and the Minister under
section 3(1) of
Schedule 12 to
the Act;
(c) "registry service" means any service included in the
definition of "registry services" as set out in
section 1 of
Schedule 12 to the Act;
(d) "service charge" means the amount charged by a registry
agent for carrying out a registry service, but does not include
(
i) any merchant fee or charge that may be incurred
through the use of a credit card or debit card, or
(ii) any other fee or charge that a registry agent must
collect, or is authorized to collect, in accordance with
the agreement or otherwise;
(e) "total fee" means the sum of the service charge and any fee
prescribed in the enactment under which a registry service is
carried out.
Service charges
2(1) Subject to subsections (2) and (3), a registry agent may set the
service charge for carrying out a registry service for which the
registry agent is authorized to carry out under an agreement.
(2) The maximum service charge that a registry agent may charge
for carrying out a registry service listed in
Schedule 1 is the amount
prescribed in
Schedule 1 for the registry service.
(3) The registry services listed in
Schedule 2 are designated as
registry services for which an individual who is 65 years of age or
older and a resident of Alberta shall receive a 25% reduction from
the total fee,
(
i) in the case of a registry service listed in Part A, in accordance
with the Operator Licensing and Vehicle Control Regulation
(AR 320/2002),
(ii) in the case of a registry service listed in Part B, in accordance
with the Identification Card Regulation (AR 221/2003),
(iii) in the case of a registry service listed in
Part C, in accordance
with the Tariff of Fees Regulation (AR 120/2000),
(iv) in the case of a registry service listed in Part D, in accordance
with the Marriage Act Regulation (AR 162/2000), and
(
v) in the case of a registry service listed in Part E, in accordance
with the Vital Statistics Ministerial Regulation
(AR 106/2018).

Section 14 is amended in subsections (1) and (2) by
adding "issuing" after "fee for".
6 The following is added after
section 14:
Applicants 65 years or older - total fee reduction
14.1(1) Notwithstanding
section 14, an applicant who provides
proof, satisfactory to the Minister, that the applicant is 65 years of
age or older at the time an application is submitted for the provision
of a registry service listed in the
Schedule shall receive a 25%
reduction from the total fee.
(2) The 25% reduction from the total fee must first be applied to the
fee set out in
section 14.
(3) In the event the fee set out in
section 14 is less than the 25%
reduction applied in subsection (2),
(
a) the service charge must be reduced by the amount necessary
to provide a 25% reduction from the total fee, and
(
b) the Minister shall reimburse the registry agent for the
reduction applied to the service charge.
7 The following is added after
section 15:
Waiver of fees
15.1 The Minister may, if the Minister considers it appropriate,
waive any fee, or portion of any fee, required to be paid under this
Regulation.

MARRIAGE ACT AMENDMENT REGULATION

1 The Marriage Act Regulation (AR 162/2000) is amended
by this Regulation.
Section 1 is amended by adding the following after
clause (c):
(d) "registry agent" means a registry agent as defined in
section
1 of
Schedule 12 to the Government Organization Act;
(e) "service charge" means the amount charged by a registry
agent in accordance with the Registry Service Charges
Regulation (AR 183/2005);
(f) "total fee" means the sum of the marriage licence fee set out
section 5.1 and the service charge.
3 The following is added after
section 5.1:
Party to a marriage 65 years or
older - total fee reduction
5.11(1) If either party to an intended marriage provides proof,
satisfactory to the Registrar, that, at the time an application is
submitted for a marriage licence, the party
(
a) is 65 years or older, and
(
b) is a resident of Alberta
then the total fee must be reduced by 25%.
(2) The 25% reduction from the total fee must first be applied to the
marriage licence fee set out in
section 5.1.
(3) In the event the marriage licence fee is less than the 25%
reduction applied in subsection (2),
(
a) the service charge must be reduced by the amount necessary
to provide a 25% reduction from the total fee, and
(
b) the Registrar shall reimburse the registry agent for the
reduction applied to the service charge.
4 This Regulation comes into force on March 31, 2024.

CONTROL AMENDMENT REGULATION

1 The Operator Licensing and Vehicle Control Regulation
(AR 320/2002) is amended by this Regulation.
2 The following is added after
section 17:
Reimbursement for medical form
17.1(1) In this section, "medical form" means the Medical
Examination for Motor Vehicle Operators form established by the
Registrar for use by a physician, nurse practitioner or any other type
of health care provider designated by the Registrar.
(2) A person who is 65 years or older who has had a medical form
completed as part of a requirement under subsection (3) may apply
to the Registrar for a reimbursement of 25% of the cost incurred for
the completion of the medical form.
(3) Subject to subsection (4), the completion of a medical form must
be in relation to a requirement by a person
(
a) to undergo a medical or physical examination if directed by
the Registrar under
section 15(2)(b),
(
b) who has disclosed to the Registrar a disease or disability that
may be expected to interfere with the safe operation of a
motor vehicle by the person under
section 16(1),
(
c) to file with the Registrar a medical examination or vision
screening report under
section 16(2), or
(
d) to file with the Registrar a medical examination report under
section 16(3).
(4) A person is not entitled to receive a reimbursement of the cost
incurred for
(
a) the completion of a medical form in relation to any further
medical reports or visual screening reports if required by the
Registrar under
section 17(b), or
(
b) any other medical or functional assessments or examination
reports that a person may be required to obtain under this
Regulation.
(5) In order to receive a reimbursement under this section, a person
must provide proof, satisfactory to the Registrar, that the person met
the age requirement at the time the medical form was completed.
3 The following is added after
section 137:
Residents 65 years or older -
total fee reduction
137.01(1) In this section,
(a) "registry agent" means a registry agent as defined in
section
1 of
Schedule 12 to the Government Organization Act;
(b) "registry service" means any service included in the
definition of "registry services" as set out in
section 1 of
Schedule 12 to the Government Organization Act;
(c) "service charge" means the amount charged by a registry
agent in accordance with the Registry Service Charges
Regulation (AR 183/2005);
(d) "total fee" means the sum of any fee prescribed under this
Regulation for a registry service listed in
Schedule 3 and the
service charge for the registry service.
(2) Notwithstanding anything in this Regulation, an individual shall
receive a 25% reduction from the total fee for the provision of a
registry service listed in
Schedule 3 if the individual provides proof,
satisfactory to the Registrar, that, at the time an application is
submitted for the provision of the registry service, the individual
(
a) is 65 years or older, and
(
b) is a resident of Alberta.
(3) The 25% reduction from the total fee for the provision of a
registry service listed in
Schedule 3 must first be applied to any fee
prescribed under this Regulation for the provision of the registry
service.
(4) In the event the prescribed fee is less than the 25% reduction
applied in subsection (3),
(
a) the service charge must be reduced by the amount necessary
to provide a 25% reduction from the total fee, and
(
b) the Registrar shall reimburse the registry agent for the
reduction applied to the service charge.
