Definitions Définitions 24.1 The following

definitions apply in this Part. 24.1 Les définitions qui suivent s’appliquent à la pré ‐ sente partie. “chief officer” means a chief of police or the Com ‐ manding Officer of the “J” Division of the Royal Cana ‐ dian Mounted Police. (agent en chef) “disciplinary authority” means a person or entity who, at the time of a serious incident, has the power to deal with disciplinary matters relating to the subject officer. “investigative body” means an entity that has the power to investigate a serious incident and includes the head of the investigative body, investigators and other employees of the investigative body. (organisme d’en ‐ quête) “officer” means a member of a police force or a mem‐ ber of the Royal Canadian Mounted Police. (agent) “police agency” means a police force or the “J” Divi ‐ sion of the Royal Canadian Mounted Police. (service de police) “serious incident” means any death, serious injury, sexual assault or act of intimate partner violence that may have resulted from the actions of a subject officer or any other matter involving a subject officer that is deter ‐ mined to be in the public interest to be investigated. (in‐ cident grave) “subject officer” means any of the following persons who is the subject of an investigation of a serious inci ‐ dent or whose actions may have resulted in a serious in ‐ cident: (

a) an officer; (

b) an auxiliary police constable; or (

c) an appointee as defined in the Cross-Border Po‐ licing Act. (agent impliqué)

Powers as peace officer Pouvoirs des agents de la paix 24.4 In carrying out an investigation of a serious inci ‐ dent, the head of the investigative body and any investi ‐ gator who is not an officer has all the powers, authority, privileges, rights and immunities of a peace officer and constable in and for the Province. 24.4 Dans le cadre d’une enquête sur un incident gra ‐ ve, le chef de l’organisme d’enquête et tout enquêteur qui n’est pas un agent ont tous les pouvoirs, l’autorité, les privilèges, les droits et les immunités d’un agent de la paix et d’un constable dans et pour la province.

Notifying head of investigative body of serious incident Avis d’incident grave au chef de l’organisme d’enquête 24.5(1) A chief officer who has reason to believe that a serious incident may have occurred shall, as soon as the circumstances permit, notify the head of the investi ‐ gative body and shall submit to the head of the investiga‐ tive body a notification report, in the form and manner determined by the head of the investigative body within the time prescribed by regulation. 24.5(1) Dès que les circonstances le permettent, l’agent en chef qui a des raisons de croire qu’un incident grave a pu se produire en avise le chef de l’organisme d’enquête et lui remet un rapport de notification, sous la forme et de la manière que détermine ce dernier, dans le délai imparti par règlement. 24.5(2) If the Minister has reason to believe that a seri‐ ous incident may have occurred, the Minister may notify the head of the investigative body. 24.5(2) S’il a des raisons de croire qu’un incident gra ‐ ve a pu se produire, le ministre peut en aviser le chef de l’organisme d’enquête. 24.5(3) Any other person who has reason to believe that a serious incident may have occurred may notify the head of the investigative body in the manner required by the head of the investigative body. 24.5(3) Toute autre personne qui a des raisons de croire qu’un incident grave a pu se produire peut en avi ‐ ser le chef de l’organisme d’enquête de la manière qu’il exige.

Investigations Enquêtes 24.6 On notification of a serious incident under

e) direct that the investigative body oversee, ob ‐ serve, monitor or review an investigation conducted under paragraph (

b) or (d),

e) ordonner à l’organisme d’enquête de superviser, d’observer, de surveiller ou d’examiner la manière dont l’enquête est menée en vertu de l’alinéa b) ou d); (

f) appoint an observer or community liaison officer to work with the investigative body, police agency or investigative unit, police force, person or other entity in another province or territory of Canada that con ‐ ducts the investigation of the serious incident,

f) nommer un observateur ou un agent de liaison communautaire pour travailler avec l’organisme d’en ‐ quête ou le service de police qui mène l’enquête ou avec l’unité d’enquête, le corps de police, la personne ou l’entité d’une autre province ou d’un territoire du Canada qui la mène; (

g) file a conduct complaint with the chair of the Commission or with the appropriate chief of police or deputy chief of police,

g) déposer une plainte pour inconduite auprès du président de la Commission ou auprès du chef de po ‐ lice ou du chef de police adjoint approprié; (

h) refer the matter under the complaints process in

Part 7 of the Royal Canadian Mounted Police Act (Canada), or

i) determine that the matter is not within the man ‐ date of the investigative body.

Summary of investigation Résumé d’enquête 24.8(1) The head of the investigative body shall, within the time prescribed by regulation, provide to the Minister and the relevant disciplinary authority a sum ‐ mary of an investigation conducted under paragraph 24.6(a), (

b) or (

d) containing the information prescribed by regulation. 24.8(1) Le chef de l’organisme d’enquête remet au mi ‐ nistre et à l’autorité disciplinaire concernée le résumé de l’enquête menée en vertu de l’alinéa 24.6a),

b) ou

d) le‐ quel renferme les renseignements prescrits par règle ‐ ment, et ce, dans le délai qui y est imparti. 24.8(2) The head of the investigative body or the Min ‐ ister shall make the

Annual report Rapport annuel 24.9 The Minister shall ensure that an annual report containing the following information is made available to the public in the manner determined by the Minister: 24.9 Le ministre s’assure qu’un rapport annuel est ren ‐ du public de la manière qu’il détermine et que celui-ci renferme les renseignements suivants : (

a) the number of investigations started and con ‐ cluded in the year;

a) le nombre d’enquêtes démarrées et terminées au cours de l’année; (

b) the nature of each investigation;

b) la nature de chacune; (

c) the result of each investigation;

c) le résultat de chacune; (

d) the number of charges laid against subject offi ‐ cers in the year;

d) le nombre d’accusations déposées contre des agents impliqués au cours de l’année; (

e) any financial or administrative information that the Minister considers appropriate; and

e) tout renseignement financier ou d’ordre adminis ‐ tratif que le ministre estime approprié; (

f) any other information prescribed by regulation.

Section 38 of the Act is amended by adding after paragraph (

partie II.1, notamment : (

i) prescribing the time in which a notification re‐ port shall be submitted to the head of the investiga ‐ tive body, (

summary of an investigation shall contain, (ii) prescrivant les renseignements que doit ren ‐ fermer le résumé d’enquête, (iii) prescribing the time in which a
