OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice dated October 27, 2005, and pursuant to Sections 672.38, 672.39 and 672.4 of

Chapter C-46 of the Revised Statutes of Canada, 1985, the Criminal Code, is pleased to: (

a) reappoint Dr. Richard Howard of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Review Board for a term of 3 years commencing November 1, 2005; (

b) reappoint Dr. Michael Teehan of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Review Board for a term of 3 years commencing November 1, 2005; (

c) reappoint J. Walter Thompson, Q.C., of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Review Board for a term of 3 years commencing November 1, 2005; (

d) reappoint Peter Lederman of Truro, Colchester County, as a member and Chair of the Nova Scotia Review Board for a term of 3 years commencing November 23, 2005; (

e) determine the remuneration of Dr. Richard Howard, Dr. Michael Teehan and J. Walter Thompson, Q.C., be at the rate of $75.00 per hour, together with reasonable expenses; (

f) determine the remuneration of Peter Lederman as Chair be at the rate of $150.00 per hour to a maximum of 55 hours per month, together with reasonable expenses; and (

g) order that the Province shall defend, negotiate or settle claims or charges made against Dr. Richard Howard, Dr. Michael Teehan, J. Walter Thompson, Q.C, and Peter Lederman and indemnify them from personal liability provided that the Province is satisfied that the claim arises out of their activities in relation to their appointment and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
