Loi sur l’éducation Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 1 of the Education Act,

chapter E-1.12 of the Acts of New Brunswick, 1997, is amended by adding the following

definitions in alphabetical order: 1 L’article 1 de la

chapitre E-1.12 des Lois du Nouveau-Brunswick de 1997, est modifié par l’adjonction des définitions qui suivent dans l’ordre al- phabétique : “positive learning and working environment” means a safe, productive, orderly and respectable learning and working environment free from bullying, cyberbullying, harassment and other forms of disruptive or non-tolerated behaviour or misconduct, including behaviour or miscon- duct that occurs outside school hours and off the school grounds to the extent the behaviour or misconduct affects the school environment; “serious misconduct” means any behaviour exhibited by a person that is viewed by the school or school district officials as extreme and unacceptable in the New Bruns- wick public education system, including (

a) bullying, (

b) cyberbullying, (

c) hazing or any other form of intimidation, (

d) possessing, using or providing weapons, « inconduite grave » désigne le comportement d’une personne que les responsables de l’école ou du district scolaire jugent d’une gravité extrême et inacceptable dans le système d’éducation publique du Nouveau-Brunswick, notamment :

a) l’intimidation;

b) la cyberintimidation;

c) les séances d’initiation ou toute autre forme de me- nace;

d) la possession, l’utilisation ou le trafic d’armes;

e) la possession, l’utilisation ou le trafic de sub- stances ou d’objets dangereux ou illégaux;

f) la distribution de tout matériel de propagande hai- neuse; 1

e) possessing, using or selling illegal or dangerous substances or objects, (

f) disseminating hate propaganda material, and (

g) any other behaviour that would reasonably be considered a serious misconduct;

g) tout autre comportement qui serait considéré rai- sonnablement comme une inconduite grave; « milieu propice à l’apprentissage et au travail » désigne le milieu d’apprentissage et de travail qui est sécuritaire, productif, ordonné, respectueux d’autrui et libre d’intimi- dation, de cyberintimidation, de harcèlement et de toutes autres formes de comportement perturbateur ou non toléré ou de toute autre forme d’inconduite, y compris le com- portement ou l’inconduite qui se produit en dehors des heures de classe ou à l’extérieur de la cour d’école et qui nuit au milieu scolaire; 2 Paragraph 13(1)(

b) of the Act is amended by striking out “best interests of the child” and substituting “best interests of the child and the school community”. 2 L’alinéa 13(1)

c) the following: 4 Le paragraphe 28(2) de la Loi est modifié par l’ad- jonction de ce qui suit après l’alinéa c) : (c.1) ensuring that a positive learning and working environment plan is developed and implemented, in collaboration with the Parent School Support Commit- tee at the school and, where appropriate, with students, and report regularly to the Parent School Support Com- mittee at the school and the superintendent of the school district with respect to the progress and effectiveness of the plan, c.1) s’assurer que le plan pour un milieu propice à l’apprentissage et au travail est élaboré et mis en oeuvre en collaboration avec le comité parental d’appui à l’école et, s’il y a lieu, avec les élèves et présenter pé- riodiquement des rapports aux comités parentaux d’ap- pui à l’école et au directeur général du district scolaire sur les progrès et l’efficacité du plan, (c.2) to report any incident of serious misconduct to the superintendent of the school district, c.2) rapporter au directeur général du district scolaire tout incident d’inconduite grave, 5

Section 33 of the Act is amended by adding after subsection (1) the following: 5 L’article 33 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 33(1.1) The Parent School Support Committee at the school shall advise the principal of the school respecting the establishment, implementation and monitoring of the positive learning and working environment plan, which may include 33(1.1) Le comité parental d’appui à l’école conseille le directeur de l’école au sujet de l’établissement, de la mise en oeuvre et de la surveillance du fonctionnement du plan pour un milieu propice à l’apprentissage et au travail, le- quel peut comporter : (

a) strategies and practices to promote respectful be- haviour and a positive and inclusive social climate for all students and staff,

a) des stratégies et des pratiques visant à promouvoir un comportement respectueux d’autrui et à créer un cli- mat social positif et inclusif pour tous les élèves et le personnel; Projet de loi 45 Loi modifiant la

b) strategies and programs to prevent disrespectful behaviour or misconduct,

b) des stratégies et des programmes visant à prévenir le comportement irrespectueux d’autrui et l’inconduite; (

c) policies and practices to address disrespectful be- haviour or misconduct in a timely manner and in a way that teaches and reinforces respect for other persons, and

c) des directives et des pratiques pour aborder la question du comportement irrespectueux d’autrui ou de l’inconduite dans un délai raisonnable et de manière à enseigner et à renforcer le respect d’autrui; (

d) appropriate support strategies for students partic- ipating in disrespectful behaviour and students who have been affected by the disrespectful behaviour of others.

h) of the Act is repealed and the following is substituted: 6 L’alinéa 36.9(5)

h) prepare annually, for submission to the Minister,

i) a report that identifies priorities respecting cap- ital construction projects within the school district, and (

a) in paragraph (

g) by striking out “and” at the end of the paragraph;

section 56.1 the following: 8 La Loi est modifiée par l’adjonction de ce qui suit après l’article 56.1 : Publication of annual report Publication du rapport annuel 56.2 The Minister shall lay an annual report on bullying in the New Brunswick public education system before the Legislative Assembly during the course of the regular ses- sion of the Legislature that follows the year for which the report is made. 56.2 Le Ministre dépose un rapport annuel sur l’intimi- dation au sein du système d’éducation publique du Nouveau-Brunswick à l’Assemblée législative au cours de la session ordinaire de la Législature qui suit la fin de l’an- née visée par le rapport.
