Statute: Public Highways Act Expropriation Act

OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated October 31, 2023, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act , and

Section 80 of

Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , is pleased to: (

a) extinguish the right of the public to use that part of the public highway, identified as Parcel "Z", that includes land containing an area of 4,572.95 square metres (1.13 acres), more or less, situate at or near Hampton, Annapolis County, and more particularly described in

Schedule "A" and as shown on

Schedule "B" attached to and forming part of the Report and Recommendation, to facilitate the release of the Crown interest to be consolidated with the lands of the abutting landowners, as their interests appear; (

b) authorize the conveyance of the parcel of surplus land, Parcel "Z", to the abutting landowners Donald and Dawna Butterfield, Garth and Diane Thompson, Bruce Automotive Group NS Limited, Howard David Grover, Gail Ogden Grover and Marshall David Grover, and Donald and Heather Marshall, all of Hampton, Annapolis County, for the nominal consideration of $1.00, as their interests appear; (

c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein above described; and (

d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
