OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated January 20, 2000, pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and
Section 80 of
Chapter 156 of the said Revised Statutes, the Expropriation Act, is pleased to: (
a) extinguish the right of the public to use that portion of the public highway system containing 0.514 acre, more or less, situate at Merigomish, Pictou County, and dispose of surplus land containing 0.08 acre, more or less, situate at Merigomish, Pictou County, and more particularly described in
Schedule "A" and shown outlined in red on
Schedule "B" which schedules are attached to and form part of the report and recommendation; (
b) convey the 0.08 acre of surplus land in addition to the said 0.514 acre of surplus highway at Merigomish, Pictou County, for a total of 0.594 acre, to Aubrey W. Mason of Merigomish, Pictou County, for $565.22 subject to a utility easement in favor of Maritime Tel and Tel and Nova Scotia Power Inc. for the purposes of access and maintaining services; and (
c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.
