An Act to Amend the Maritime Provinces Harness Racing Commission Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 1 of the Maritime Provinces Harness Racing Commission Act,

chapter M-1.3 of the Acts of New Brunswick, 1993, is amended by repealing the definition “rules” and substituting the follow- ing: “rules” means the rules referred to in paragraphs 10(

i) and (i.1); 2

Section 2 of the Act is repealed and the follow- ing is substituted: 2 The purpose of this Act is to establish a harness racing authority with jurisdiction to govern, regu- late and ensure the integrity of harness racing in the Maritime Provinces. 3

Section 10 of the Act is amended (

a) by repealing paragraph (

a) and substitut- ing the following: (

a) régir, réglementer et surveiller les courses attelées dans tous ses aspects qui se rapportent et sont reliés au pari mutuel,

b) by adding after paragraph (

a) the follow- ing: (a.1) govern and regulate inter-track betting, separate pool betting, foreign race inter-track betting and foreign race separate pool betting, (a.2) govern and regulate the operation of bet- ting theatres authorized by the Lieutenant- Governor in Council, (

c) by repealing paragraph (

b) and substitut- ing the following: (

b) govern, regulate and supervise the opera- tion of race tracks, (

d) by adding after paragraph (

b) the follow- ing: (b.1) recommend home market areas to the Ca- nadian Pari-Mutuel Agency for the purpose of telephone account betting and theatre betting, (b.2) license betting theatres and impose such terms and conditions on a licence as the Commis- sion considers appropriate, (

e) by repealing paragraph (c); (

f) by adding after paragraph (

i) the follow- ing: (i.1) establish uniform rules for the conduct of harness racing, (

g) by repealing subparagraph (j)(ii) and sub- stituting the following: (ii) of any rule, and (

h) by repealing paragraph (

k) and substitut- ing the following: (

k) recruit, train, evaluate, license and employ harness racing judges and such other officials

e) par l’abrogation de l’alinéa c);

f) par l’adjonction après l’alinéa (

i) de ce qui suit : i.1) établir des règles uniformes pour la con- duite des courses attelées,

g) par l’abrogation du sous-alinéa j)(ii) et son remplacement par ce qui suit : (ii) de toute règle, et

h) par l’abrogation de l’alinéa k) et son rem- placement par ce qui suit :

k) recruter, former, évaluer et employer des ju- ges de courses attelées et les autres agents et

i) by adding after paragraph (

t) the follow- ing: (t.1) intervene as a facilitator or mediator for the purpose of convening parties to attempt to bring resolution to matters in dispute where it deems it necessary for the governance, regulation and integrity of harness racing, and delegate this power to any person, 4 Paragraph 19(1)(

b) of the Act is repealed and the following is substituted: (

b) recommendations with respect to the oper- ation, governance and regulation of harness rac- ing in the Maritime Provinces, and 5 Paragraph 19.1(

b) of the Act is repealed and the following is substituted: (

b) to a rule, 6 The Act is amended by adding after

An Act to Amend the Maritime Provinces Harness Racing Commission Act Bill 11 EXPLANATORY NOTES

Section 1 The amendment is consequential on the amendment made in paragraph 3(

f) of this amending Act. The existing definition is as follows: “rules” means rules for the conduct of harness racing made, adopted or incorporated by reference under

section 10;

Section 2 The existing provision is as follows: 2 The purpose of this Act is to establish a harness racing au- thority with jurisdiction to govern and regulate harness racing in the Maritime Provinces.

Section 3 (

a) The existing provision is as follows: 10 The Commission may (

a) govern, regulate, direct, control, supervise, promote and market harness racing, (

b) New provisions. (

c) The existing provision is as follows: 10 The Commission may (

k) employ harness racing judges and such other officials and staff as the Commission considers appropriate to attend at harness racing meets on behalf of the Commission, (

i) New provision.

Section 4 The existing provision is as follows: 19(1) The Commission shall on or before the thirtieth day of June in each year submit to the Council an annual report contain- ing (

b) recommendations with respect to the operation of har- ness racing in the Maritime Provinces, and

Section 5 The amendment is consequential on the amendment made in paragraph 3(

f) of this amending Act. The existing provision is as follows: 19.1 The Regulations Act does not apply (

b) to a rule made, adopted or incorporated by reference under this Act,

Section 6 New provision.
