Section 1 of the Crown Construction Contracts Act,

chapter 105 of the Revised Statutes, 2014, is amended by adding the following definition in alphabetical or- der: 1 L’article 1 de la

Section 2 of the Act is repealed and the following is substituted: 2 L’article 2 de la Loi est abrogé et remplacé par ce qui suit : 2(1) Subject to subsection (2), this Act applies to every contract for the construction, repair or alteration of land or structures owned or administered by the Crown. 2(1)

a) a non-routine capital project of the New Bruns- wick Power Corporation, carried out alone or with other parties, that has been approved by the New Brunswick Power Corporation’s Board of Directors, or

b) an energy infrastructure project of any entity in which, directly or indirectly, the Crown holds an in- terest.

a) shall be made in the Short Form Contract or the Standard Construction Contract, if the amount of the accepted tender does not exceed the amount prescri- bed by regulation, or

b) shall be made in the Standard Construction Con- tract, if the amount of the accepted tender is greater than the amount prescribed by regulation.

b) du contrat type de construction, si le montant de la soumission retenue excède le montant fixé par rè- glement. 2.1(2) With the approval of the Treasury Board, the Minister of Transportation and Infrastructure may pre- scribe the form and content of the Short Form Contract and the Standard Construction Contract, which may vary according to the class of contracts. 2.1(2) Avec l’approbation du Conseil du Trésor, le mi- nistre des Transports et de l’Infrastructure peut préciser la forme et la teneur du contrat abrégé et du contrat type de construction, lesquels peuvent varier selon la catégo- rie de contrats. 2.1(3) The Minister of Transportation and Infrastruc- ture shall cause the Short Form Contract and the Stand- ard Construction Contract to be made available to the public in the form and the manner that he or she consid- ers appropriate. 2.1(3) Le ministre des Transports et de l’Infrastructure rend publics le contrat abrégé et le contrat type de cons- truction sous la forme et selon le mode qu’il estime indi- qués. 2.1(4) In the Short Form Contract or the Standard Construction Contract, the Crown may collect personal information either directly from an individual to whom the information relates or indirectly from another person. 2.1(4) Dans le contrat abrégé ou le contrat type de construction, la Couronne peut recueillir des renseigne- ments personnels, que ce soit directement auprès de la personne physique concernée ou par l’entremise d’une autre personne. 2.1(5) The Regulations Act does not apply to the form and content of the Short Form Contract and the Standard Construction Contract. 2.1(5) La

Loi sur les règlements ne s’applique pas à la forme ni à la teneur du contrat abrégé et du contrat type de construction. 2.1(6) If there is a conflict or an inconsistency between the Short Form Contract or the Standard Construction Contract and this Act or any regulation made under this Act, this Act or the regulation made under this Act pre- vails. 2.1(6) La présente loi et ses règlements l’emportent sur tout contrat abrégé ou contrat type de construction incompatible.

Machinery rental rates Tarifs de location des machines 2.2(1) With the approval of the Treasury Board, the Minister of Transportation and Infrastructure may pre- scribe machinery rental rates. 2.2(1) Avec l’approbation du Conseil du Trésor, le mi- nistre des Transports et de l’Infrastructure peut fixer les tarifs de location des machines. 2.2(2) The Minister of Transportation and Infrastruc- ture shall cause the machinery rental rates to be made available to the public in the form and the manner that he or she considers appropriate. 2.2(2) Le ministre des Transports et de l’Infrastructure rend publics les tarifs sous la forme et selon le mode qu’il estime indiqués. 2.2(3) The Regulations Act does not apply to the ma- chinery rental rates. 2.2(3) La

Loi sur les règlements ne s’applique pas aux tarifs. 2.2(4) Subject to subsection (6), the machinery rental rates apply to all contracts to which this Act and the reg- ulations apply. 2.2(4)

section applies to performance bonds and payment bonds furnished to the Crown in relation to a contract administered on behalf of the Crown by the Minister of Transportation and Infrastructure. 7.1(1) Le présent

article s’applique aux cautionne- ments d’exécution et de paiement fournis à la Couronne par rapport à tout contrat qu’administre le ministre des Transports et de l’Infrastructure pour le compte de la Couronne. 7.1(2) The Minister of Transportation and Infrastruc- ture may prescribe standard terms and conditions not in- consistent with this Act or the regulations that are to be included in performance bonds and payment bonds. 7.1(2) Le ministre des Transports et de l’Infrastructure peut préciser des modalités et des conditions types com- patibles avec la présente loi et ses règlements et à inclure dans les cautionnements d’exécution et de paiement. 7.1(3) The standard terms and conditions may vary ac- cording to the type of bond or the class of the contract to which the bond relates. 7.1(3) Les modalités et les conditions types peuvent varier selon le type de cautionnement ou la catégorie de contrat auquel se rapporte le cautionnement. 7.1(4) The Minister of Transportation and Infrastruc- ture shall, on behalf of the Crown, refuse to accept any performance bond or payment bond that does not include the standard terms and conditions. 7.1(4) Le ministre des Transports et de l’Infrastructure doit, pour le compte de la Couronne, refuser d’accepter tout cautionnement d’exécution ou de paiement qui ne comporte pas les modalités et les conditions types. 7.1(5) The Minister of Transportation and Infrastruc- ture shall cause the standard terms and conditions to be made available to the public in the form and the manner that he or she considers appropriate. 7.1(5) Le ministre des Transports et de l’Infrastructure rend publiques les modalités et les conditions types sous la forme et selon le mode qu’il estime indiqués.

7.1(6) The Regulations Act does not apply to the standard terms and conditions. 7.1(6) La

Section 8 of the Act is amended 5 L’article 8 de la Loi est modifié (

a) by adding after paragraph (

e) the following:

section 2.1(1); e.1) fixer le montant aux fins de l’application du pa- ragraphe 2.1(1); (e.2) prescribing procedures to be followed in nego- tiating or awarding contracts; e.2) établir la procédure à suivre dans le cadre de la négociation ou de l’attribution des contrats; (e.3) respecting the negotiation of contracts follow- ing a tender opening; e.3) prendre des mesures concernant la négociation de contrats à la suite de l’ouverture des soumissions; (e.4) prescribing the manner of calculating an oper- ator’s wages for the purposes of subsection 2.2(5); e.4) prévoir le mode de calcul du salaire du conduc- teur aux fins de l’application du paragraphe 2.2(5); (

b) by repealing paragraph (f).

a) by renumbering the

section as subsection 3(1);
