1 The following

definitions apply in this regulation.

"association" means Manitoba Oat Growers Association Inc. (« Association »)

"oats" means oats produced in Manitoba. (« avoine »)

Purpose

2 The purpose of this regulation is to enable the association to collect money from oat producers to promote and financially support initiatives in the areas of production, marketing, extension, education and research, for the benefit of oat producers in Manitoba.

Objet

2 L'objet du présent règlement est de permettre à l'Association de recueillir des fonds auprès des producteurs d'avoine dans le but de promouvoir et de soutenir financièrement des projets relatifs à la production, à la commercialisation, à la formation, notamment sur le terrain, et à la recherche, dans l'intérêt des producteurs d'avoine du Manitoba.

Designation

3 Manitoba Oat Growers Association Inc. is designated as the representative organization of all producers of oats in Manitoba.

Fees

4 Every producer who produces and markets oats must pay a fee to the association of $0.75 per tonne of oats.

Deduction of fees

5(1) Every purchaser who buys oats from a producer must deduct from the money payable to the producer the fees payable by the producer to the association.

5(1) L'acheteur d'avoine déduit des sommes qu'il doit au producteur les cotisations que celui-ci est tenu de verser à l'Association.

5(2) Within one month after the end of each of the following periods, every purchaser must forward to the association the fees deducted during the period:

(

a) the period beginning on February 1 and ending on April 30;

(

b) the period beginning on May 1 and ending on July 31;

(

c) the period beginning on August 1 and ending on October 31;

(

d) the period beginning on November 1 and ending on January 31 of the following year.

5(2) Les acheteurs sont tenus de faire parvenir à l'Association, au plus tard un mois après la fin de chaque période indiquée ci-après, les cotisations qu'ils ont déduites pendant cette période :

a) la période commençant le 1 er février et se terminant le 30 avril;

b) la période commençant le 1 er mai et se terminant le 31 juillet;

c) la période commençant le 1 er août et se terminant le 31 octobre;

d) la période commençant le 1 er novembre et se terminant le 31 janvier de l'année qui suit.

5(3) When fees are forwarded to the association under subsection (2), the purchaser must also provide the association with the following information:

(

a) the name, mailing address and e-mail address of each producer from whom the fees were withheld;

(

b) the amount of the fees being forwarded on that producer's behalf;

(

c) the quantity of oats purchased from that producer.

5(3) Les acheteurs joignent aux cotisations qu'ils font parvenir à l'Association conformément au paragraphe (2) les renseignements suivants :

a) le nom, l'adresse postale et l'adresse électronique de chaque producteur à l'égard duquel des cotisations ont été retenues;

Use of fees

6 The association is authorized to use the fees for the purpose of defraying the expenses of the organization in carrying out its purpose.

6 L'Association est autorisée à utiliser les cotisations pour payer les dépenses qu'elle engage aux fins de la réalisation de son objectif.

Refunds

7(1) A producer may apply to the association for a refund of fees.

7(1) Les producteurs peuvent demander à l'Association de leur rembourser les cotisations.

7(2) An application for a refund must be made in writing on a form provided by the association and must contain the information that the association requests.

7(2) Les demandes de remboursement sont présentées par écrit à l'Association au moyen d'une formule que celle-ci fournit et qui contient les renseignements qu'elle demande.

7(3) An application for a refund must be received by the association

(

a) before March 1 for fees deducted in the six-month period beginning on the previous August 1 and ending on January 31; and

(

b) before September 1 for fees deducted in the six-month period beginning on the previous February 1 and ending on July 31.

7(3) Les demandes de remboursement doivent parvenir à l'Association :

a) avant le 1 er mars, dans le cas des cotisations qui ont été déduites au cours de la période de six mois commençant le 1 er août précédent et se terminant le 31 janvier;

b) avant le 1 er septembre, dans le cas des cotisations qui ont été déduites au cours de la période de six mois commençant le 1 er février précédent et se terminant le 31 juillet.

7(4) If the application for a refund complies with this section, the association must make a refund

(

a) not later than April 30 for fees deducted in the six-month period beginning on the previous August 1 and ending on January 31; and

(

b) not later than October 31 for fees deducted in the six-month period beginning on the previous February 1 and ending on July 31.

7(4) L'Association donne suite aux demandes de remboursement conformes au présent

article en faisant parvenir le remboursement :

a) au plus tard le 30 avril, dans le cas des cotisations qui ont été déduites au cours de la période de six mois commençant le 1 er août précédent et se terminant le 31 janvier;

b) au plus tard le 31 octobre, dans le cas des cotisations qui ont été déduites au cours de la période de six mois commençant le 1 er février précédent et se terminant le 31 juillet.

Books and records

8 Every purchaser of oats must keep and maintain complete and accurate books and records respecting the purchase of oats and provide copies of them when requested to do so by the agency.

9 The association must furnish to the agency such information and financial statements as the agency determines necessary to ensure that the fees paid to the association are properly used for the purpose of the association.
