An Act to Amend the Tobacco Tax Act Loi modifiant la Loi de la taxe sur le tabac Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 1 of the Tobacco Tax Act,

chapter T-7 of the Revised Statutes, 1973, is amended by adding the follow- ing definition in alphabetical order: 1 L’article 1 de la Loi de la taxe sur le tabac, chapi- tre T-7 des Lois révisées de 1973, est modifié par l’ad- jonction de la définition qui suit selon son ordre alpha- bétique : “arm’s length” means arm’s length within the meaning of

section 251 of the Income Tax Act (Canada); (lien de dépendance) « lien de dépendance » s’entend au sens de l’article 251 de la Loi de l’impôt sur le revenu (Canada); (arm’s length) 2

Section 2 of the Act is amended 2 L’article 2 de la Loi est modifié (

a) in subsection (4.2) by striking out “cancelled” and substituting “revoked”;

a) au paragraphe (4.2), par la suppression de « an- nulée » et son remplacement par « révoquée »; (

b) in subsection (4.3)

b) au paragraphe (4.3) (

i) by repealing paragraph (

a) and substituting the following: (

a) the applicant has been convicted of a violation of a provision of this Act or the regulations or a provision relating to tobacco in any other Act of the Legislature, any Act of any other province or territory of Canada, any Act of the Parliament of Canada or any regulation or statutory instrument under those Acts,

a) que le requérant a été déclaré coupable d’une vio- lation d’une disposition de la présente loi ou des règle- ments ou d’une disposition concernant le tabac dans toute autre loi de la Législature, toute loi d’une autre province ou de l’un quelconque territoire du Canada, toute loi du Parlement du Canada ou tout règlement ou texte réglementaire pris en vertu de ces lois, 1

(ii) in paragraph (

c) by adding after subsection (4.3) the following:

a) the applicant is not at arm’s length from a person who has violated or failed to comply with a provision of this Act or the regulations or a provision relating to tobacco in any other Act of the Legislature, any Act of any other province or territory of Canada, any Act of the Parliament of Canada or any regulation or statutory instrument under those Acts, or

a) soit qu’il existe un lien de dépendance entre le re- quérant et une personne qui a enfreint ou omis d’obser- ver une disposition de la présente loi ou des règlements ou une disposition concernant le tabac dans toute autre loi de la Législature, toute loi d’une autre province ou de l’un quelconque territoire du Canada, toute loi du Parlement du Canada ou tout règlement ou texte régle- mentaire pris en vertu de ces lois; (

b) a retail vendor’s licence for the retail location sought by the applicant is suspended or has been re- voked within the previous 24 months.

d) by repealing subsection (6) and substituting the following:

d) par l’abrogation du paragraphe (6) et son rem- placement par ce qui suit : 2(6) The Minister may suspend a licence for a period of time established in accordance with the regulations or may revoke a licence if the Minister has reasonable and prob- able grounds to believe that the licensee has failed to com- ply with a provision of this Act or the regulations or has been convicted of a violation of a provision relating to to- bacco in any other Act of the Legislature, any Act of any other province or territory of Canada, any Act of the Par- liament of Canada or any regulation or statutory instru- ment under those Acts. 2(6) Le Ministre peut suspendre une licence pour une période établie conformément aux règlements ou peut la révoquer s’il a des motifs raisonnables et probables de croire que le titulaire de la licence a omis d’observer une disposition de la présente loi ou des règlements ou qu’il a été déclaré coupable d’une violation d’une disposition concernant le tabac dans toute autre loi de la Législature, toute loi d’une autre province ou de l’un quelconque ter- ritoire du Canada, toute loi du Parlement du Canada ou tout règlement ou texte réglementaire pris en vertu de ces lois. (

e) by adding after subsection (6) the following:

e) par l’adjonction de ce qui suit après le paragra- phe (6) : 2(6.1) The Minister may suspend a retail vendor’s li- cence for a period of time established in accordance with the regulations or may revoke a retail vendor’s licence if the Minister has reasonable and probable grounds to be- lieve that the licensee has failed to comply with any term or condition imposed on the licence. 2(6.1) Le Ministre peut suspendre une licence de ven- deur au détail pour une période établie conformément aux règlements ou peut la révoquer, s’il a des motifs raison- nables et probables de croire que le titulaire de la licence ne s’est pas conformé à quelque modalité ou condition que ce soit dont elle est assortie. (

f) in subsection (7) by striking out “subsection (6)” and substituting “subsection (6) or (6.1)”;

g) by adding after subsection (7) the following:

g) par l’adjonction de ce qui suit après le paragra- phe (7) : 2(8) If the Minister refuses to issue a retail vendor’s li- cence or imposes terms and conditions on a retail vendor’s licence, the applicant for the licence or the licensee, as the case may be, may submit a written request for review to the Commissioner within 14 days after being notified of the refusal or the terms and conditions. 2(8) Si le Ministre refuse de délivrer une licence de ven- deur au détail ou l’assortir de modalités et de conditions, le requérant ou le titulaire de la licence, selon le cas, peut déposer par écrit une demande de révision auprès du Com- missaire dans les 14 jours après avoir été avisé du refus ou des modalités et des conditions. 2(9) If the Minister suspends or revokes a retail vendor’s licence, the licensee may submit a request for review to the Commissioner within 14 days after being notified of the suspension or revocation. 2(9) Si le Ministre suspend ou révoque une licence de vendeur au détail, le titulaire de la licence peut déposer une demande de révision auprès du Commissaire dans les qua- torze jours après avoir été avisé de la suspension ou de la révocation. 2(10) Within 14 days after receipt of the request for re- view under subsection (8) or (9), the Commissioner shall review the decision of the Minister and shall confirm, vary or revoke that decision and the decision of the Commis- sioner is final and binding. 2(10) Dans les quatorze jours de la réception de la de- mande de révision que prévoit le paragraphe (8) ou (9), le Commissaire peut réviser la décision du Ministre et la confirme, la modifie ou la révoque, la décision du Com- missaire étant définitive et obligatoire.
