Loi sur le changement de nom 1(1)

Section 1 of the Change of Name Act,

chapter 103 of the Revised Statutes, 2014, is amended in the definition “child” by striking out “under 19 years of age who is not married” and substituting “under 16 years of age”. 1(1) L’article 1 de la

Section 4 of the Act is amended 1(2) L’article 4 de la Loi est modifié (

a) in paragraph (1)(

a) by striking out “19 years of age” and substituting “16 years of age”;

5(2.2) Despite subsection (2), an applicant may make an application to the court to dispense with the consent of a parent required under this

section and a judge, hav- ing regard to the best interests of the child, may dispense with the required consent and the Registrar General shall comply with the decision of the judge. 5(2.2) Par dérogation au paragraphe (2), le demandeur peut présenter à la Cour une requête pour qu’elle re- nonce au consentement du parent qu’exige le présent ar- ticle et le juge, eu égard à l’intérêt supérieur de l’enfant, peut y renoncer et le registraire général se conforme à la décision du juge. 5(2.3) If a child has sought the consent of a parent re- quired under this

section and that parent objects to the change of the registered name of the child and has re- fused to consent, the child may apply to the court for an order respecting the change of the registered name of the child and the Registrar General shall comply with that order. 5(2.3) S’il a tenté d’obtenir le consentement d’un pa- rent qu’exige le présent

Section 1 of the Vital Statistics Act,

chapter V-3 of the Acts of New Brunswick, 1979, is amended 2(1) L’article 1 de la

a) by adding the following

definitions in alphabet- ical order:

a) par l’adjonction des définitions qui suivent se- lon l’ordre alphabétique : “child”, unless the context otherwise indicates, means a person under 16 years of age; (enfant) “court ”means The Court of Queen’s Bench of New Brunswick; (Cour) “custody”, in relation to a person having custody of a child, includes custody shared with another person or persons; (garde) “judge” means a judge of The Court of Queen’s Bench of New Brunswick; (juge) “parent”, unless otherwise specified, means (

a) the natural parent of a child except if the child has been legally adopted in which case it means the adoptive parent, and (

b) a person with whom a child ordinarily resides and who demonstrates a settled intention to treat the child as a child of the person’s family; (parent) “personal service”, with respect to a document, means personal service as described in Rule 18 of the Rules of Court and “served personally” has a corresponding meaning; (signification à personne) “sex designation” means the recorded sex of a person on the birth registration of the person; (désignation de sexe) « Cour » désigne la Cour du Banc de la Reine du Nouveau-Brunswick; (court) « désignation de sexe » s’entend de la mention du sexe visant une personne enregistrée qui apparaît sur le bulletin d’enregistrement de sa naissance; (sex designa- tion) « enfant » s’entend, sauf indication contraire du con- texte, d’une personne âgée de moins de 16 ans; (child) « garde » relativement à la personne à qui est confiée la garde d’un enfant, est assimilée à la garde celle qu’elle partage avec une ou plusieurs autres personnes; (custo- dy) « juge » s’entend d’un juge à la Cour du Banc de la Reine du Nouveau-Brunswick; (judge) « parent » s’entend, sauf indication contraire du con- texte :

a) is 16 years of age or older, and

b) was born in the Province or has been ordinarily resident in the Province for at least three months im- mediately before the date of the application.

b) a written statement from a health professional prescribed by regulation who has treated, evaluated or consulted with the applicant that confirms that the sex designation of the applicant is inconsistent with the gender with which the applicant identifies and, as a result, the sex designation of the applicant should be changed, and

b) la déclaration écrite émanant d’un professionnel de la santé désigné par règlement qui a traité ou éva- lué le demandeur, ou que ce dernier a consulté, et qui confirme que sa désignation de sexe ne correspond pas à son identité de genre et que, conséquemment, il faudrait changer sa désignation de sexe; (

c) any other document or other evidence that is prescribed or that is required by the Registrar General.

c) tout autre document ou tout autre élément de preuve prescrit ou qu’exige le registraire général. 34(3) Instead of conforming to the requirement of paragraph (2)(b), an application may include a certificate signed by a medical practitioner legally qualified to practise medicine in the jurisdiction in which gender confirming surgery was performed on the applicant 34(3) Plutôt que de se conformer à l’exigence de l’ali- néa (2)b), la demande peut comprendre un certificat re- vêtu de la signature d’un médecin légalement qualifié pour exercer la médecine sur le territoire de compétence où le demandeur a subi la chirurgie de confirmation du genre, lequel : (

2(3) The Act is amended by adding after

section 34 the following: 2(3) La Loi est modifiée par l’adjonction de ce qui suit après l’article 34 : 34.1(1) A parent may apply to the Registrar General under this

section to change the sex designation of a child of whom the parent has lawful custody if the child was born in the Province or the child and parent have been ordinarily resident in the Province for at least three months immediately before the date of the application. 34.1(1) Un parent peut présenter au registraire général, en vertu du présent article, une demande de changement de désignation de sexe d’un enfant dont il a la garde lé- gale, si l’enfant est né dans la province ou si l’enfant et le parent y résident ordinairement depuis au moins trois mois immédiatement avant la date de la demande. 34.1(2) The Registrar General may consider an appli- cation under this

section with respect to a child who was not born in the Province and who has not been ordinarily resident in the Province for at least three months imme- diately before the date of the application if, in the opin- ion of the Registrar General, the child 34.1(2) Le registraire général peut examiner la de- mande présentée en vertu du présent

c) the written consent of the applicant on a form provided by the Registrar General,

d) the written consent of all other parents of the child on a form provided by the Registrar General or, if there are no other parents of the child, confirmation that there are no legal proceedings ongoing in relation to the parentage or custody of the child, and

e) any other document or other evidence that is prescribed or that is required by the Registrar General.

a) subparagraph (3)(a)(ii) applies and the applicant is unable to provide the required written consent of the child 12 years of age or over,

b) the applicant did not notify all parents of the child who are required to be notified under subsection (4), or

c) the Registrar General believes that it is in the best interests of the child not to proceed.

section 34.5 within 90 days after receipt of the no- tice to a judge in the judicial district in which the child resides.

section and that parent objects to the change in sex designation and has refused to consent, the child may apply to the court for an order respecting the change of sex designation and the Registrar General shall comply with that order. 34.1(8) S’il a tenté d’obtenir le consentement d’un pa- rent qu’exige le présent
