On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that the Administrative Penalties

Regulation, B.C. Reg. 35/2011, is amended as set out in the attached Schedule.

Schedule

Section 2 (1) of the Administrative Penalties Regulation, B.C. Reg. 35/2011,

is amended by striking out " under

section 49 of the Act " and substituting " under

section 43.4 or 49 of the Act ".

Section 5 is amended

(

a) in subsection (4) by striking out " 26 (1) (b), 27, 39 (2) " and substituting " 26 (1) (b), 39 (2) ",

(

b) in subsection (5) by striking out " 39 (3) or (8), 42 (2) " and substituting " 39 (3), 42 (2) " and by striking out " 45 (2) or (3), 46, 47 (b) " and substituting " 45 (2) or (3), 47 (b) ", and

(

c) in subsection (6) by striking out " 41 (4), (4.1), (5) or (6) " and substituting " 41 (4), (4.1) or (6) ".

3 The following

section is added:

Dormancy and Shutdown Regulation

(1) A person who contravenes

section 15 (1), (2) or (3), 16 (3), 17 (3) or 18

(5) of the Dormancy and Shutdown Regulation is liable to an administrative penalty not

exceeding $500 000.

(2) A person who contravenes

section 18 (3) or (4) of the Dormancy and Shutdown

Regulation is liable to an administrative penalty not exceeding $200 000.

(3) A person who contravenes

section 16 (1) or (2) or 17 (1) or (2) of the Dormancy

and Shutdown Regulation is liable to an administrative penalty not exceeding $100 000.

(4) A person who contravenes

section 11, 13 or 14 of the Dormancy and Shutdown

Regulation is liable to an administrative penalty not exceeding $50 000.
