EXPLANATORY NOTE NOTE EXPLICATIVE This Bill amends The Human Rights Code . Le présent projet de loi modifie le Code des droits de la personne . The list of protected characteristics under the Cod e is expanded to cover social disadvantage and gender identity. Le projet de loi étend la liste des caractéristiques protégées par le Code afin qu'elle inclue le désavantage social et l'identité sexuelle.

The Bill streamlines the handling of complaints in several ways. h The Human Right Commission may sit in panels to consider complaints. h The Commission and the adjudicator at a hearing are authorized to explore the settlement of complaints. h An adjudicator can deal with similar complaints involving different parties in a single hearing. h The position of chief adjudicator is created.

Par ailleurs, le projet de loi simplifie le traitem ent des plaintes de plusieurs façons : h la Commission des droits de la personne du Manitoba peut constituer des comités afin d'examiner les plaintes; h la Commission et l'arbitre qui tient une audience sont autorisés à tenter de régler les plaintes; h un arbitre peut statuer sur des plaintes semblables mettant en présence différentes parties dans le cadre d'une audience unique; h le poste d'arbitre en chef est créé. Fines under the Code are increased. The time allowe d for filing a complaint or starting a prosecution under the Code is increased.

Section 1 is amended (

a) by repealing the definition "dog guide"; and (

b) by adding the following

definitions: "chief adjudicator" means the person designated as chief adjudicator under subsection 8(1.1); (« arbitre en chef ») "service animal" means an animal that has been trained to provide assistance to a person with a disability that relates to that person's disability ; (« animal d'assistance ») 2

a) in clause (f), by adding " sex-determined characteristics or circumstances, such as " after " sex, including "; (

b) by replacing clause (

g) with the following: (

g) gender identity; (

c) in clause (l), by striking out " dog guide or other animal assistant " and substituting " service animal "; and (

d) by adding the following after clause (l): (

Failure to accept reasonable settlement offer 24.1(4) If a complainant rejects a settlement offer made by the respondent before an adjudicator is appointed to hear the complaint, the Commission mus t terminate its proceedings in respect of the complain t if the Commission considers the offer to be reasonable . Section 26 is amended by striking out "section 29 " and substituting "

section 24.1 or 29 ". 11

a) a panel has all the jurisdiction of the Commission and may exercise the Commission's powers and perform its duties; and (

Delivery of material from hearing to Commission 46(4) The adjudicator must send the sound recordings of proceedings at the hearing, and all documents and materials filed at the hearing, to th e Commission as soon as (

a) the deadline for applying for judicial review of the adjudicator's final decision under subsection 50(2) expires, if no application for judicial review is made by that deadline; or (

b) all proceedings in respect of the judicial review of the adjudicator's final decision have concluded, if an application for judicial review of the final decision is made.
