Content of notice

1 A director issuing a notice under subsection 37(2) of The Apprenticeship and Certification Act must specify the following in the notice:

(

a) if it is the person's first, second or a subsequent failure to comply with a compliance order;

(

b) the amount of the administrative penalty is determined as follows:

Amount

(

i) first contravention

$1,000,

(ii) second contravention

$3,000,

(iii) third or subsequent contravention

$5,000.

Le directeur doit, dans l'avis qu'il remet en vertu du paragraphe 37(2) de la

Loi sur l'apprentissage et la reconnaissance professionnelle , indiquer :

a) s'il s'agit de la première ou de la deuxième contravention à un ordre d'observation commise par la personne ou s'il s'agit d'une contravention subséquente;

b) le montant de la sanction administrative, lequel correspond à ce qui suit :

Coming into force

3 This regulation comes into force on the same day that The Apprenticeship and Certification Act , S.M. 2009, c. 33, comes into force.
