CHAPTER

An Act to amend The Environmental Management and Protection Act (Assented to August 25, 1989) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

Short title1 This Act may be cited as The Environmental Management and Protection Amendment Act, 1989. S.S. 1983-84, c.E-10.2, new

section

Section of The Environmental Management and Protection Act is repealed and the following substituted: Offences and penalties "35(1) Every person who: (

a) contravenes any provision of this Act or the regulations made pursuant to this Act or the regulations described in subsection 42(1); or (

b) fails to comply with an order of the minister or with a directive made pursuant to the powers conferred on a project manager pursuant to

section 6; is guilty of an offence and liable on

summary conviction to a fine not exceeding $1,000,000, to imprisonment not exceeding three years or to both that fine and imprisonment. "

(2) If a corporation has committed an offence provided for in subsection (1), any officer, director or agent of the corporation who directed, authorized, assented to, acquiesced in or participated in the commission of the offence: (

a) is a party to and guilty of the offence; and (

b) is liable on

summary conviction to the punishment provided for the offence; whether or not the corporation has been prosecuted or convicted". Coming into force3 This Act comes into force on the day of assent.
